Judge Arbour Rec. 10 – sexual-related files, Occupational Transfer (OT)

Case summary

F&R Date: 2025-06-04

The grievor contested the decision to deem them unsuitable to become a Military Police Officer (MPO). The grievor contends that the selection process was unfair as it was disproportionately based on the unverified information given by one character reference. As redress, the grievor requests that such discriminatory practices be ceased and that personnel within the Canadian Armed Forces Military Police Service (CFMPS) receive education on such issues. Additionally, they seek the removal of the assessment indicating that they were deemed unsuitable, as well as a trade change to the MPO occupation.

The Commander of the Canadian Forces Military Police Group, acting as the Initial Authority (IA), found that the grievor had been treated fairly in accordance with the applicable rules, regulations, and policies, and denied granting the grievor redress. The IA explained that following a thorough review of the application, there was no evidence of bias, prejudice, or negligence in the criteria used during the selection process.

After reviewing the information related to the assessment, the Committee found no evidence of prejudice and discrimination in the selection process. The Committee found and concurred with CFMPS's decision to deem the grievor unsuitable, based on an attempt to influence the information provided by the character reference to the selection board. Such attempts to manipulate, obscure, or conceal information during the selection process constitute unacceptable behaviour, as they would in any other occupational or position-specific selection process. The Committee recommended that the Final Authority not afford the grievor redress.
