The grievor contended that they were employed in a position identified at the rank of Major-General (MGen), without the rank or the pay associated with the position.

Compensation and Benefits Instruction (CBI) Article 204.21(4) (Acting Pay – Senior Officers) states, in part, that an officer in the substantive rank of colonel or above who is appointed to a position of higher rank shall be paid in accordance with Instructions for the administration of acting pay in Appendix D of the Salary Administration Policy for the Executive Group, issued by the Treasury Board Secretariat (TBS).

The Committee found that the grievor was posted to a position established at the rank of MGen where the grievor performed the full scope of duties and responsibilities for a period of two years. As stated in the CBI, acting pay for senior officers in the Canadian Armed Forces mirrors the executive compensation of the public service, which includes a condition that acting pay will apply after a person has been performing all or a significant part of the duties of a higher-level position for three months, retroactive to the date the acting assignment commenced. For periods exceeding 12 months, prior approval must be sought from the TBS.

The Committee concluded that the grievor had been aggrieved and recommended that the Final Authority grant acting pay. As the total period exceeded 12 months, the Committee recommended that the Chief of Defence Staff seek authorization from the TBS to ensure the entire applicable period is covered.
