This case was decided by Pierre Rousseau, appeals officer.

[1]  On March 9, 2004, Mr. Ron Dastous, an employee of Securicor Cash Services Inc., assigned to a retrofit truck for the purpose of servicing ABM machines, making cash pick ups and deliveries at commercial customers, refused to work with his co-worker, because they felt the communications arrangements were inadequate to protect their safety and security in the event the Ground Positioning System (GPS) failed again. At this time they were given a third crew member to act as a guard in order to complete the run.

[2]  Health and safety officer Bob Tomlin investigated into Mr. Dastous' refusal to work and following his investigation decided that a danger did not exist for him. He advised Mr. Dastous of his decision on March 9, 2004. On reception of the decision, Mr. Dastous, appealed the decision of health and safety officer Tomlin pursuant to subsection 129.(7) of the Canada Labour Code.

[3]  On March 15, 2004, Mr. Dastous subsequently withdrew his appeal. I therefore confirm the withdrawal and declare the matter to be closed.
