This case was decided by Pierre Rousseau, appeals officer.
[1] On April 23, 2003, Mr. Robert Dougald, Customs officer appealed the decision of no danger issued by health and safety officer Gerry McCabe, following his refusal to work of April 22, 2003.
[2] Mr. Dougald's statement of the refusal to work was: "Prior to be fitted for masks we were asked to fill out a medical questionnaire, I answered yes to two questions and was advised that I could not be tested until I was examined by a medical doctor."
[3] Mr. Dougald advised the Canada Appeals Office on Occupational Health and Safety on October 22, 2004, that he no longer wanted to proceed and he therefore withdrew his appeal.
[4] Based on the facts provided to me in this case, it appears that this appeal was withdrawn and I confirm that the file on this matter is closed.
