This case was decided by Pierre Rousseau, appeals officer.
[1] On May 5th, 2003, Mr. Richard Robillard, employee of Securicor Canada Limited, as an armed guard, appealed the decision of no danger issued by health and safety officer Renée Roussel following his refusal to work. Mr. Robillard and coworker Jeff Koeliger refused to enter the shopping center, on the indication that they had previously tested the S-Series Remote Device and it did not work.
[2] Based on the scant facts provided to me in this case, it appears that the Union decided not to make any representation on this file and will abide by the decision of the Appeals Officer concerning the previous cases already submitted to the Officer. On October 28 we received a fax signed by Mr. Robillard, mentioning that he had decided to withdraw his appeal.
[3] Since the appeal has been withdrawn, I now confirm that the file on this matter is closed.
