FACTS - JOB language requirements. ISSUES - Standing to grieve; need to show griever aggrieved; bilingual capacity of central service unit; improper intervention in grievance process. Member grieves Job Opportunity Bulletin containing English essential language requirements, requests amendment to reflect needs of Unit. Record shows UBC never met.
On July 5, 1991, the ERC issued its findings and recommendations. Member has onus to establish how aggrieved; no prejudice shown here; can only speculate on basis of grievance. Unfortunate: bilingual capability of unit is serious concern here, there were complaints of inadequate service to clients. Intervention of OIC improper; no role in grievance process except to serve documents, which should be in sealed envelopes to prevent breach of privacy. Comments of OIC detrimental to process. Recommended better protecting privacy, and denying grievances for lack of standing.
On August 30, 1991, the Commissioner rendered his decision. Intervention of OIC inappropriate; privacy guidelines now in effect but further direction to be provided. Griever not meeting requirements of s.31 RCMP Act, has burden of proof, not establishing he was aggrieved. No standing, grievance denied.
