In 1995, the Grievor ran as a candidate for mayor of a municipality. The RCMP undertook an investigation to determine whether the Grievor had in so doing contravened the RCMP Code of Conduct. He was then suspended without pay. The Grievor presented a grievance against this decision. A year and a half later, the decision was retroactively revoked. The Grievor maintained his grievance however because he said he was entitled to be compensated for the adverse effect on him.

ERC Findings

Since the Grievor was unsuccessful in his legal action before the Superior Court of Quebec, in which he sought moral and exemplary damages, the RCMP is not authorized to pay him any compensation under the present grievance.

Committee's Recommendation of October 1, 2003

The grievance should be denied.

Commissioner of the RCMP Decision dated November 12, 2003

The Commissioner agreed with the findings and recommendations of the Committee. The grievance is thus denied.
