NC-273 - Harassment
The Appellant appealed the Respondent’s decision dismissing his harassment complaint on the basis that the Alleged Harasser’s actions did not amount to harassment. The Appellant argues that the Decision was reached in a procedurally unfair manner and is clearly unreasonable. In the Appellant’s view, the Respondent demonstrated a reasonable apprehension of bias, made clearly unreasonable findings, and failed to consider relevant evidence.
ERC Findings
The ERC found that the Appellant has not met the onus of proving a reasonable apprehension of bias. The ERC also found that the Appellant has not demonstrated that the Respondent made clearly unreasonable findings nor that she failed to consider relevant evidence.
ERC Recommendation
The ERC recommends that the appeal be dismissed.
