Narrative

The Access to Information Act requires a legislative review every five years with the first review launched in June 2020 and completed in December 2022. The Access to Information Regulations will be revisited after each review of the Access to Information Act to ensure that they align with any changes that may be made as a result of these reviews. The proposed changes published in the Canada Gazette, Part I (pages 6224 to 6233), on December 24, 2022, will bring the Access to Information Regulations in line with the current version of the Access to Information Act. The Access to Information Review launched in June 2020 examined the current and future state of access to information regime in Canada. This Access to Information Review, which recently concluded in December with the tabling of the report, is available at Access to Information Review Report to Parliament.

Narrative

The review of these regulations was driven by the Government of Canada’s commitment to promoting and protecting official languages within the federal public service and with members of the public across the country. Provisions requiring amendments were identified to clarify the circumstances under which institutions must communicate with, and provide services to, the public in English, in French, or in both official languages.

Targeted start for review (year)

The amended Official Languages Regulations requires a review be undertaken every 10 years. This review is expected to start in 2026–27 in order to be completed by 2029.

Outcomes

The review of these Regulations was completed in 2019. Amended Regulations were registered by the Clerk of the Privy Council on June 25, 2019, and published in the Canada Gazette, Part II, on July 10, 2019. The review produced more inclusive official languages regulations that better reflect community needs and respond to demographic and technological changes. The amendments will also enhance Canadians’ access to federal services in both official languages.

Narrative

The review of this Order, which was instituted in 1986, is driven by the need to remove or amend a regulatory instrument that may now be outdated. As a result of recent changes under the Treasury Board Acquired services and Assets policy suite reset establishing the Policy on the Management of Investments and the Directive on the Management of Procurement, the referential legal basis under the Financial Administration Act for establishing contracting limits was updated.

Rationale

A review of the Red Tape Reduction Regulations (RTRR) is part of the legislated review of the Red Tape Reduction Act, which began in 2020. This review has been completed and the report is available at Report on the Internal Review of the Red Tape Reduction Act. The next review of the RTRR and its associated policies are expected to take place approximately every five years alongside routine regulatory policy reviews.

Narrative

The Red Tape Reduction Act, brought into effect in 2015, sets out requirements for federal departments and agencies to control the growth of administrative burden on business when developing regulations (that is, the one-for-one rule). The RTRR set out the requirements for calculating administrative burden, reconciliation timelines, exemptions, and reporting.

The RTRR and its associated policies will be examined as part of routine regulatory policy review led by TBS.
