Review of regulations to support the Government of Canada’s Red Tape Review by reducing unnecessary or outdated regulatory burden, clarifying regulatory ownership and determining the continued relevance of financial management regulations.
Narrative
The review of regulations related to financial management is being undertaken in the context of the Government of Canada’s Red Tape Review, which asked departments and agencies to identify outdated, overlapping or administratively burdensome regulatory requirements and to propose actions to reduce red tape. As part of that exercise, TBS identified a number of near-term initiatives related to financial management regulations, as described in its Red Tape Review Progress Report.
This longer-term stock review complements the Red Tape Review initiatives related to:
- amending selected financial management regulations to reduce red tape
- examining opportunities for regulatory overlap and modernization
Building on that work, this regulatory stock review will take a longer-term and more comprehensive look at financial management regulations made under the Financial Administration Act and related statutes. The regulations included in this cluster address a range of functions, including financial management policy, payment administration, debt management and legal enforcement mechanisms.
While TBS is responsible for financial management policy, certain regulations are administered operationally by the Receiver General for Canada or relate to legal authorities administered by the Department of Justice Canada. Accordingly, this review will be undertaken in coordination with responsible organizations to assess continued relevance, identify modernization opportunities (including digital enablement), clarify regulatory ownership, and examine potential overlap or duplication between regulatory instruments.

The review produced more inclusive official languages regulations that better reflect community needs and respond to demographic and technological changes. Rationale
As part of the Red Tape Review Progress Report initiative, TBS committed to undertake a review of existing policy tools to reduce red tape to help ensure the regulatory system remains current and support efforts to eliminate outdated regulations, reduce duplication and deliver better services. This will include a review of the Red Tape Reduction Act and the corresponding Red Tape Reduction Regulations. These efforts will build on the findings of the 2020 internal review of the Red Tape Reduction Act, available at Report on the Internal Review of the Red Tape Reduction Act.
Narrative
The Red Tape Reduction Act, brought into effect in 2015, sets out requirements for federal departments and agencies to control the growth of administrative burden on business when developing regulations (that is, the one-for-one rule). The Red Tape Reduction Regulations set out the requirements for calculating administrative burden, reconciliation timelines, exemptions and reporting.
The Red Tape Reduction Regulations and its enabling act will be reviewed as part of commitments outlined in the Treasury Board of Canada Secretariat Red Tape Review Progress Report.
