Canadian Armed Forces Military Personnel Instruction 14/77 – Officers on Subsidized University Courses Ceased Training

2. Background

2.1 References A and B do not provide direction concerning the procedure to be used when an officer undergoing subsidized university training under the University Training Plan - officers (UTPO) or Post Graduate Training (PGTRG) ceases training due to academic failure or voluntarily withdraws. Additionally, direction is required with respect to disciplinary problems involving personnel in these training plans.

3. Aim

3.1 This instruction provides the procedures to be followed when a commissioned officer undergoing subsidized university training fails his course of study, voluntarily withdraws from his course or study or becomes a disciplinary problem during his period of subsidization.

4. Course Failure

4.1 In the event that commissioned officer, who is undergoing subssidized university training, is assessed by the academic institution providing the instruction as a failure or unable to complete the academic program in the normally prescribed period, the following procedures will be followed:

  1. the student is to be removed from his academic training;
  2. the Commandant of the Canadian Military College or the Base Commander, in the case of an officer at a civilian institution, will report to National Defence Headquarters (NDHQ)/DPED upon the circumstances surrounding the failure. The Commandant's observations are to be included;
  3. normally, an officer who fails academically will be returned to regular duty. If the failure occurs after the officer has been subsidized for six months or more, the obligatory period of service specified in CFAO 15-2, Release – Regular Force, will apply;
  4. upon receipt of the Commandant's Base Commander's report, NDHQ/DPED will make recommendations to NDHQ/Director Personnel Careers Officers (DPCO) on what career action should be taken;
  5. if required, NDHQ/DPCO will ensure that the necessary action is taken to find a replacement.

5. Voluntary Withdrawals

5.1 In the event that a commissioned officer, who is undergoing subsidized university training, request voluntary withdrawal from their academic training, the following procedures will be implemented:

  1. the student will continue has academic training until approval to withdraw has been received from NDHQ;
  2. the Commandant or Base Commander will investigate the circumstances leading to the request for voluntary withdrawal. This investigation, together with the Commandant's or Base Commander's observations and recommendations, will be forward to NDHQ/Director General Recruiting, Education and Training (DGRET);
  3. under normal circumstances, once selected, an officer is expected to complete his academic program to meet an identified Canadian Forces requirement. If his request for voluntary withdrawal is approved the officer is subject to the obligatory period of service specified in CFAO 15-2;
  4. upon receipt of the Commandant's or Base Commander's recommendations, NDHQ/DGRET will recommend to NDHQ/Director General Personnel Careers Officers (DGPCO) what career action should be taken;
  5. if required, NDHQ/DGPCO will ensure that the necessary action is taken to find a replacement.

6. Disciplinary Problems

6.1 An officer undergoing subsidized university training, who becomes a disciplinary problem will be dealt with as folllows:

  1. the commandant or Base Commander will inform NDHQ/DGRET of the alleged disciplinary problem as soon as possible;
  2. the investigation of the charge and disposition of the charge will be in accordance with QR&O;
  3. the results of para 6b. above will be forward to NDHQ/CPD along with the Commandant's or Base Commander's recommendation as to whether the commissioned officer should continue on subsidized university training;
  4. after review by NDHQ/DGRET and NDHQ/DGPCO/Chief Personnel Careers and Senior Appointments (CPCSA) will determine what career action should be taken;
  5. if it is necessary to withdraw the commissioned officer from subsidized university training:
    1. the officer is subject to the obligatory period of service specified in CFAO 15-2,
    2. NDHQ/DGPCO will ensure that the necessary action is taken to find a replacement.

7. Summary

7.1 Officers undergoing subsidized university training have been carefully selected and should represent the more talented officers of the Canadian Armed Forces with above average potential. Academic personal or disciplinary problems are unlikely to arise with this group of Officers. However, if these circumstances do occur, then NDHQ control required to ensure that the selection process does not select unsatisfactory officers.
