DAOD 7000-0, Affidavits and Statutory Declarations

1. Introduction

Date of Issue: 1998-03-31

Application: This is an order that applies to members of the Canadian Armed Forces (CAF) and a directive that applies to employees of the Department of National Defence (DND).

Supersession: CFAO 59-1, Affidavits and Statutory Declarations – Commissioned Officer's Authority under Provincial Laws

Approval Authority: This DAOD is issued under the authority of the Judge Advocate General (JAG).

2. Definitions

affidavit (affidavit)

An affidavit is a statement made in writing sworn to or affirmed in front of a person having the authority to administer the oath or affirmation.

statutory declaration (déclaration solennelle)

A statutory declaration is a solemn declaration made in writing by a party knowing and intending it to have the same effect as though it were a declaration made under the Canada Evidence Act.

3. Policy Direction


3.1 Affidavits and statutory declarations are used to establish legal rights. If not properly made, legal rights may be impaired or destroyed.

3.2 Members of the CAF, their dependants and other civilians directly associated with the CAF may require the completion of an affidavit or statutory declaration for military or civilian matters.

Policy Statement

3.3 Subject to the conditions in applicable provincial and territorial laws (see DAOD 7000-1), a commissioned officer may administer an oath or take an affirmation or statutory declaration only for:

  1. another member of the CAF;
  2. a dependant of another member; or
  3. a civilian directly associated with the CAF.
