1. Introduction

Date of Issue: 2004-09-03

Application: This is an order that applies to officers and non-commissioned members of the Canadian Armed Forces (CAF members).

Supersession: CFAO 26-10, Wills

Approval Authority: This DAOD is issued under the authority of the Judge Advocate General (JAG).

2. Policy Direction

Context

2.1 When a CAF member dies, it is necessary to distribute the member's service estate. Distribution of the service estate will be as follows:

Policy Statement

2.2 Every CAF member is strongly encouraged to make a will if they do not already have one, and to review its provisions periodically.

Requirements

2.3 The CAF shall provide each CAF member with the opportunity, particularly at enrolment, to make a will and:

  1. place their will in safekeeping with the CAF; or
  2. record their will's location if not held in CAF custody.

2.4 Commanding officers shall bring the importance of having a current and valid will to the attention of CAF members under their command by making an entry each year in routine orders with reference to this DAOD and DAOD 7012-1, Preparation and Administration of Wills.
