Public communication CAN 2023-1 (Vietnam) – Accepted for review

On March 15, 2023, a public communication under Chapter 19 (Labour) of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) was filed by the Vietnamese Canadian Federation (VCF) with the support of VCF member associationsFootnote 1, the Vietnamese Community in South Australia – SA Chapter Inc., and the Communauté des Réfugiés Politiques Vietnamiens en Europe based in France.

The submission primarily alleges that Vietnam’s labour laws are not in compliance with the CPTPP Chapter 19 (Labour) obligations related to the rights to freedom of association and collective bargaining under the International Labour Organization (ILO) Declaration on Fundamental Principles and Rights at Work and its Follow-up (1998, ILO Declaration).

The submitters encourage the Canadian National Administrative Office (NAO) to undertake a number of actions, including the review of Vietnam’s full compliance with its labour chapter obligations under the CPTPP.

On March 21, 2023, the NAO notified the submitters that the public communication was accepted for review. In accordance with Guidelines for Public Communications, the NAO will examine the submission and report on the issues raised within 180 days from the date the public communication was accepted for review or the date of any supplemental submission.
