Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999 (CEPA), the conditions of disposal at sea permit no. 4543‑2‑06766 are amended as follows and published on the CEPA Registry on Tuesday, February 11, 2014.

3. Duration of permit: permit is valid from February 18, 2014 to February 17, 2015.

3.1. The loading and disposal at sea activities in the Tabusintac Gully, Inner Channel Disposal Site are restricted to the following period(s): February 18, 2014 to March 31, 2014.

4. Loading site(s):

1. Tabusintac Gully, New Brunswick, 47.32284° N; 64.92367° W North American Datum of 1983 (NAD83), as described in the site plan (April 2013) submitted in support of the permit application

2. Tabusintac Gully, Inner Channel, New Brunswick, 47.38121°N; 64.93333°W (NAD83), as described in drawing “CAN-ATL-62.1” (January 27, 2014)

5. Disposal site(s):

1. Tabusintac Gully, New Brunswick, 47.32284°N; 64.92367°W (NAD83), as described in the site plan (April 2013) submitted in support of the permit application

2. Tabusintac Gully, Inner Channel, New Brunswick, 47.38121°N; 64.93333°W (NAD83), as described in drawing “CAN-ATL-62.1” (January 27, 2014)

9. Total quantity to be disposed of: not to exceed 20 000 cubic metres, place measure.

14. Special precautions:

14.1. The permittee shall prepare an environmental protection plan (EEP) relating to the loading and disposal at sea activities authorized by this permit. The plan shall be approved by the Department of the Environment prior to the commencement of the first dredging operation to be conducted under this permit. Project activities shall be carried out in accordance with all procedures and mitigation measures outlined in the environmental protection plan. Modifications to the plan shall be made only with the written approval of the Department of the Environment. The EEP shall include measures to protect and/or restore eelgrass located in proximity to the Tabusintac Gully Inner Channel Disposal Site.
