Reporting Deadlines

Under the Metal and Diamond Mining Effluent Regulations (the Regulations), the owner or operator of a mine is required to notify, submit and report information about their mine to Environment and Climate Change Canada. 

The information to be sent and the deadlines are presented below, grouped according to the submission method to be used.

MERS and EEMER are accessible online through the Single Window Information Manager. You can request the Acartia tonsa reporting form via the MERS generic inbox (sdem-mers@ec.gc.ca).

Environment and Climate Change Canada will assign one or more inspectors to the mine once it becomes subject to the Regulations. You must send required information directly to the inspector assigned to your mine.

Mine Effluent Reporting System (MERS)

Identifying information 

Information related to the mine:

- the name and address of the owner, operator, and parent company of the mine, as well as the design-rated capacity of the mine.

Mine becomes subject to Regulations:

  • Submit no later than 60 days after (subsections 8(1) and 8(2)).

Ownership is transferred:

  • Submit the information related to the mine above no later than 60 days after (subsections 8(1) and 8(2)) ownership of the mine if transferred.

Mine returns to commercial operations after it has become a recognized closed mine:

  • Submit the information related to the mine above no later than 60 days after (subsections 8(1), 8(2) and paragraph 33(1)(a)) the mine returns to commercial operation.

Any other change in the identifying information:

  • Submit no later than 60 days after the change occurs (subsection 8(3)).
Final discharge points 

Information for each final discharge point:

- Plans, specifications and a general description of each final discharge point along with its latitude and longitude.

- A description of how each final discharge points is designed and maintained.

- Name of the receiving body of water, if there is a name.

Mine becomes subject to the Regulations:

  • Submit no later than 60 days after the mine is subject to the Regulations (section 9).

Final discharge points identified by an inspector:

  • Submit the information listed above related to final discharge points within 30 days after final discharge points are identified by an inspector (paragraph 10(1)a)).

New final discharge points:

  • Submit the information listed above related to final discharge points at least 60 days before effluent is deposited (paragraph 10(1)b)).

Proposed change to final discharge points:

  • Submit any changes to the information listed above related to final discharge points at least 60 days before change is to be made (subsection 10(2)).
Effluent monitoring

Reducing the frequency of effluent monitoring:

  • Notify at least 30 days in advance of reducing frequency of conducting tests (paragraph 13(6)(a)).

Reducing the frequency of acute lethality testing:

  • Notify at least 30 days before reducing frequency of testing (subsection 16(3)).
Reporting monitoring results

Quarterly effluent monitoring report for all tests and monitoring information:

  • Submit no later than 45 days after the end of the quarter (subsection 21(1)).

Annual effluent monitoring report:

  • Submit no later than March 31, the effluent monitoring results for the previous calendar year (section 22).
Notification in change of activity

The mine stop commercial operation:

  • Notify no later than 90 days after the end of commercial operation (subsection 26(1)).

The mine returns to commercial operation:

  • Notify without delay if the mine returns to commercial operation (subsection 26(2)).

Intent to close a mine (recognized closed mine):

  • Notify as determined by the owner or operator of the mine (paragraph 32(1)(a)).

Intent to reopen a recognized closed mine:

  • Notify at least 60 days before reopening the recognized closed mine (subsection 32(3)).

If a recognized closed mine becomes subject to the Regulations:

  • Notify no later than 60 days after becoming subject to the Regulations (paragraph 33(1)(a)).

If ownership of recognized closed mine is transferred:

  • Notify no later than 60 days after becoming subject to the Regulations (paragraph 33(1)(b)).

Location of all records for a recognized closed mine:

- the location, in Canada, of all records, books of account or other documents required by the Regulations.

  • Notify of their location (subsection 32(4)).
Effluent and water quality monitoring studies (Part 1 – Schedule 5)

Information related to effluent and water quality monitoring studies:

- results for effluent characterization, sublethal toxicity test and water quality monitoring data, as well as upload­ methodologies and QA/QC measures and data (such as lab certificates)

  • Submit no later than March 31 of the following year (Schedule 5, sections 8(f) and 8(g).

Unable to follow the study design due to circumstances beyond your control:

- an explanation of the circumstances and description of the changes that were made to the study

  • Submit without delay (Schedule 5, subsections 11(2), 14(2) and 19(2)).

Notification of cessation of discharge:

  • Submit without delay when the period of cessation begins (that is when effluent has not been discharged by the mine for at least 36 months) and when the mine resumes effluent discharge (Schedule 5, subsection 17(3)).

Reporting monitoring results

Quarterly effluent monitoring report for all Acartia tonsa tests and monitoring information:

  • Submit no later than 45 days after the end of the quarter (subsection 21(1)).

Annual effluent monitoring report for Acartia tonsa:

  • Submit no later than March 31, the effluent monitoring results for the previous calendar year (section 22).

Inspector

Effluent monitoring exceedance

If the results of the effluent monitoring tests indicate any of the following:

- Limits set out in Schedule 4 are being or have been exceeded;

- pH of the effluent is less than 6.0 or greater than 9.5; or

- Effluent is acutely lethal.

  • Notify without delay (subsection 24(1))
  • Report test results within 30 days of tests being completed (subsection 24(2)).
Notification of an unauthorized deposit

Unauthorized deposit:

  • Notify without delay (subsection 38(5) of the Fisheries Act).

Report following an unauthorized deposit of a deleterious substance*:

  • Submit as soon as feasible (section 31 of the Regulations) & (subsection 38(7) of the Fisheries Act).

Unauthorized deposit that is an acutely lethal effluent:

  • Notify without delay (subsection 31.1(2) of the Regulations).
Unforeseen circumstances

Unforeseen circumstances causing safety concerns or accessing problems and rendering the collection of samples of effluent impracticable:

  • Notify without delay when the collection of samples will be practicable (paragraph 25(1)(b)).

*Contact without delay the National Environmental Emergencies Centre at 1-866-283-2333 to report an unauthorized deposit.
