Background
On October 17, 2018, the Cannabis Act and the Cannabis Regulations came into force. The Cannabis Act establishes a national framework to strictly regulate and restrict access to cannabis in Canada, outside of which cannabis continues to be a prohibited substance under criminal law power. Under the Cannabis Act, federal, provincial and territorial governments share responsibility for overseeing cannabis activities including:
- production
- possession
- distribution
- sale
The purpose of the Cannabis Act is to protect public health and public safety, including providing for the legal production of cannabis to reduce illegal activities in relation to cannabis and providing access to a quality-controlled supply of cannabis. Health Canada is responsible for conducting compliance and enforcement activities under the Cannabis Act and the Cannabis Regulations.
Health Canada manages risks posed to public health and public safety in connection with cannabis through a variety of compliance and enforcement activities including compliance promotion, compliance monitoring and enforcement actions.
Compliance and enforcement activities include conducting inspections of both:
- cannabis licence holders
- individuals who have obtained the authorization of their health care practitioner to produce a limited amount of cannabis for their own medical purposes
Inspections may involve actions such as:
- visually examining a facility, inventories, equipment, packaging, labelling and websites
- collecting and reviewing documents and records
- taking samples for laboratory analysis
Regulated parties must take corrective actions during or after the inspection to address any noted deficiencies or deviations from the legislative or regulatory requirements.
The Cannabis Act contains a number of enforcement tools that may be considered in determining the appropriate actions to prevent or address non-compliance, based on a review of the situation and all relevant information, including the health or safety risk and the compliance history of the individual or corporation. These include measures ranging from compliance promotion and awareness, which are intended to educate and prevent non-compliance, up to measures intended to correct non-compliance or address a public health or safety risk, such as the issuance of a warning letter, suspension or cancellation of a federal licence, the issuance of a ministerial order, or the issuance of administrative monetary penalties (up to $1 million). This summary includes results for cannabis inspections from April 1, 2018 to March 31, 2019.
Before October 17, 2018, Health Canada was responsible for administering and enforcing the:
- Food and Drugs Act (FDA)
- Controlled Drugs and Substances Act (CDSA)
- Access to Cannabis for Medical Purposes Regulations (ACMPR)
On October 17, 2018, the ACMPR were repealed and replaced with the Cannabis Act (CA) and the Cannabis Regulations (CR).

Types and number of inspections
The types of inspections are described in the following table (Table 1).

Definitions of observations
An observation is a deficiency or deviation from legislative or regulatory requirements that is:
- noted by an inspector during an inspection and
- confirmed in writing to the licence holder in the inspection report
An observation is classified by the following types:
Critical observations
A critical observation represents the most serious deviation or deficiency of the CA or CR. Critical observations are those that are likely to:
- increase the immediate risk of diversion
- prevent the detection of diversion, or
- present an imminent health risk, or
- may also involve the possibility of deliberate fraud, misinterpretation, or falsification of information
Major observations
A major observation describes a situation that may result in a risk to public health or public safety, or may involve fraud, or may increase the risk of diversion, prevent the detection of diversion or health risk.
Minor observations
A minor observation describes a situation that is neither critical nor major, but is a deviation or deficiency from the CA or CR. Minor observations will likely not increase the risk of diversion, prevent the detection of diversion and/or health risk.
No classification
Pre-sales inspections (April 1 - October 16, 2018) assessed the licensed producer's readiness to conduct sale activity outlined within an application. Therefore, observations are not classified for these inspections.
Advertising and Promotions inspections support the assessment of compliance for promotion and advertisement activities and the associated requirements, by gathering information. Observations are not made for these inspections.
Registered personal and designated production of cannabis for medical purposes cannabis inspections assessed for any deficiency or deviation from legislative or regulatory requirements. Observations are made but are not classified for these inspections.

Inspection ratings
An inspection can be assigned a compliant or non-compliant rating, based on the number and severity of observations noted during an inspection.
Compliant rating
A compliant inspection rating means that, at the time of the inspection, the licence holder has met the applicable legislative and regulatory requirements and is in control of the regulated activities.
A compliant inspection rating may be assigned even when observations are present.
Non-compliant rating
A non-compliant inspection rating means that, at the time of the inspection, the licence holder has not met the applicable legislative and regulatory requirements, and may not be fully in control of the regulated activities.
No rating
Pre-Sales inspections conducted from April 1, 2018 to October 16, 2018, are not assigned an inspection rating since they are conducted to assess the licensed producer's readiness to conduct sale activity outlined within an application. Registered personal and designated production of cannabis for medical purposes inspections, were not assigned inspection ratings since observations were not classified.
Advertising and Promotions inspections are not assigned ratings since observations are not made. The purpose is to support the assessment of compliance for promotion and advertisement activities and the associated requirements by gathering information.
An inspection rating was assigned to 98 of 156 inspections conducted between April 1, 2018 and October 16, 2018 under the CDSA and the Access to Cannabis for Medical Purposes Regulations. Pre-sales and Advertising inspections (58 of 156) were not assigned a rating. In addition, 1 Targeted inspection also was not assigned a rating. See explanation provided in the Inspection results section.
An inspection rating was assigned to 118 of 137 inspections conducted between October 17, 2018 and March 31, 2019 under the Cannabis Act and its Regulations. Promotions and Registered personal and designated production of cannabis for medical purposes inspections (10 of 137) were not assigned a rating. A few Sales, Targeted, and Regular inspections (9 of 137) were not assigned a rating and an explanation is provided in the Inspection results section.

A total of 293 inspections were conducted from April 1, 2018 to March 31, 2019.
From April 1, 2018 to October 16, 2018, 156 inspections of regulated parties were conducted under the CDSA and the ACMPR (Figure 1).

From October 17, 2018 to March 31, 2019, 137 inspections of regulated parties were conducted under the Cannabis Act and its Regulations (Figure 2).

Measures initiated by Health Canada
Regulated parties must take corrective actions during or after the inspection to address any noted deficiencies or deviations from the legislative or regulatory requirements.
Health Canada may take enforcement actions to address non-compliance or to mitigate risks to public health or public safety. These may include, but are not limited to, issuance of warning letters, seizure and detention of products, licence suspension or revocation.
Between April 1, 2018 and October 16, 2018, under CDSA and ACMPR, four warning letters were issued to formally advise licence holders of their non-compliance and to require corrective measures, 1 seizure and detention of products was conducted and 1 licence was suspended.
Between October 17, 2018 and March 31, 2019, under the Cannabis Act and its Regulations, 1 warning letter was issued to formally advise the licence holder of their non-compliance and to require corrective measures, 1 seizure of products was conducted and 1 licence was suspended.

Inspection results
Table 2 gives inspection data for licence holders from April 1, 2018 to March 31, 2019. Details include: Licence holder's name and the province or territory where they are located, inspection start date, inspection type, if sampling was conducted, classification of observations made, inspection compliance rating, and any measures initiated by Health Canada.
All inspections beginning October 17, 2018 were conducted under the Cannabis Act and its Regulations. Inspections from April 1 to October 16, 2018 were conducted under the CDSA, ACMPR and FDA.
Advertising and Promotions inspections highlights
5 inspections at promotional events were conducted from April 1, 2018 to March 31, 2019:
- 2 in Toronto, ON
- 1 in Oro-Medonte, ON
- 1 in Victoria, BC
- 1 in Regina, SK
In addition to the on-site inspections related to promotions, Health Canada conducts additional compliance verification activities related to promotions.
Between October 17, 2018 and March 31, 2019, Health Canada conducted 85 promotions related compliance verification activities which resulted in 48 actions taken. These actions include one or more of the following: compliance promotion calls; compliance promotion letters; or referrals to RCMP. During the reporting period, Health Canada undertook:

- 3 Compliance Promotion Letters
- 4 Warning Letters
- 32 Referrals to RCMP
In addition to the above mentioned activities, Health Canada proactively engages with regulated parties through compliance promotion calls, letters and sessions. Between October 17, 2018 and March 31, 2019 the following compliance promotion activities were conducted:

Registered personal production of cannabis for medical purposes inspection highlights
During fiscal year 2018-2019, Health Canada has taken a number of steps to strengthen its oversight of persons authorized to produce a limited amount of cannabis for medical purposes. This includes:
- enhancing the verification of applications where the healthcare practitioner has authorized a high amount and those applications with multi-unit alternate production sites (i.e. not a primary residence)
- enhancing engagement and collaboration with important stakeholders, such as law enforcement and municipalities on the overall medical access regime
- sharing information on health care practitioners who are authorizing high amounts with provincial and territorial health professional licensing authorities
- applying new powers to refuse or revoke a registration on the grounds of public health and public safety; and
- increasing the focus on compliance promotion with registrants
In March 2019, 9 inspections, associated with 9 registrations, were conducted at 4 authorized production sites in the province of Ontario:
- 3 in London, ON
- 1 in Markham, ON
9 observations were made in total for the 9 inspections:
- 1 inspection resulted in no observations
- 8 inspections resulted in 1 to 2 observations for each inspection
