The Minister of Citizenship and Immigration gives the annexed Ministerial Instructions Amending the Ministerial Instructions Respecting the Express Entry System, 2025-1, under paragraph 10.3(1)(h)Footnote a of the Immigration and Refugee Protection ActFootnote b.

Amendments
1 Subparagraph 8(1)(d)(ii) of the Ministerial Instructions Respecting the Express Entry SystemFootnote 1 is repealed.
2 (1) Subsection 29(1) of the Instructions is repealed.
(2) Subsections 29(3) and (4) of the Instructions are replaced by the following:
Loss of offer or inability to perform duties
(3) If the offer is revoked or if the foreign national is unable to perform the duties of the employment or is unlikely to agree to perform them, the offer is no longer a qualifying offer of arranged employment.
3 The Instructions are amended by adding the following after section 33:
Previous version — subparagraph 8(1)(d)(ii) and section 29
34 Subparagraph 8(1)(d)(ii) and section 29 of these Instructions, as they read immediately before the day on
which this section takes effect, continue to apply to in respect of invitations issued to foreign nationals before that day where those invitations were issued on the basis of points assigned under that subparagraph and that section, as those provisions read immediately before that day.
Taking Effect
4 These Instructions take effect on March 25, 2025, but if they are given after that day, they take effect on the day on which they are given.
