A. Exclusions as a result of a non-imperative appointment

- Exclusion as a result of an agreement to become bilingual
- Exclusion for medical reasons
- Exclusion for persons eligible for an immediate annuity (and who submit their resignation)
Replaces 5 to 7 of PSOLEAO 1981
Unilingual persons appointed on a non-imperative basis as a result of a reclassification, a reorganization, a lay-off or a leave of absence have to either:
- submit an agreement to become bilingual;
- submit their resignation, if eligible for an immediate annuity; or
- be exempted on medical grounds
B. Exclusions as a result of an acting appointment
The new Public Service Employment Regulations
Exclusions from the operation of merit respecting official language proficiency
- for one or more acting appointments of less than four months in total to a vacant bilingual position which cannot be filled by a person who meets the language proficiency qualification (subsection 14(2));
- for one or more acting appointments of less than four months to an encumbered bilingual position (subsection 14(1));
- for one or more acting appointments of four months or more but not more than 12 months in total to an encumbered bilingual position which cannot be filled by a person who meets the language proficiency qualification (section 15);
- for one or more acting appointments of four months or more but not more than 18 months in total to a bilingual position while the incumbent is on language training and which cannot be filled by a person who meets the language proficiency qualification (section 16);
- any acting appointment to a position in a rotational system in order to provide for the movement of employees within and outside Canada in the following organizations:
- Department of Citizenship and Immigration;
- Department of Foreign Affairs and International Trade;
- Canadian Border Service Agency (section 17).
C. Exclusions as a result of the reidentification of language requirements of an encumbered position
Replaces 11 and 12 of PSOLEAO 1981
- Incumbents of unlingual positions where the language requirements are modified and incumbents of bilingual positions where the level of language proficiency is raised aresubject to the applicable policies and directives of the employer (Treasury Board)

- Exclusion on compassionate grounds
- Exclusion on the basis of age
- Exclusion on the basis of continuous service
- Exclusion as a result of a reclassification
- Exclusion as a result of a reorganization
- Exclusion as a result of a lay-off or a leave of absence
B. Exclusions as a result of an acting appointment
- Vacant position (for 4 or 6 months)
- While the incumbent is on language training (for duration of the training)
- While the incumbent is on certain types of leave (for duration of leave)
C. Exclusions as a result of the reidentification of language requirements of an encumbered position
- Change in the language requirements of a unilingual position
- Change in the level of language proficiency of a bilingual position
