I am pleased to present the 2020-21 Departmental Results Report for the RCMP External Review Committee (ERC).

This past fiscal year has been a challenge for all of us. As the worldwide situation related to COVID-19 impacted the ERC, like all Government of Canada organizations, the ERC adapted rapidly to the recommendations made by public health authorities and central agencies and immediately implemented working remotely for all its employees. The mental, physical health and safety of our employees was now more than ever at the forefront.

During these challenging and changing times, the ERC was also able to secure additional permanent funding to support its program capacity, which permitted ERC to hire additional staff throughout the 2021-22 fiscal year. The ERC is now in a position to meet its service standards and being successful in its strategies that have been implemented to address the backlog reduction.

The ERC would like to highlight that it has produced its second best year by issuing 75 findings and recommendations.

The ERC remains fully committed to its independent role of providing findings and recommendations which thoroughly address important employment, labour and conduct matters within the RCMP.

Results: what we achieved

Core responsibility

Independent review of RCMP employment matters

Description:

Independent and impartial case reviews, findings and recommendations for final decisions in appeals of internal RCMP decisions in harassment complaints, conduct cases, discharges or demotions, and stoppages of pay and allowances.

Results:

The COVID-19 pandemic and subsequent public health authorities and central agencies recommendations and restrictions thrusted all ERC employees into full-time working remotely. The ERC was well equipped as it had already implemented flexible work arrangements to promote and encourage work life balance to maintain a healthy lifestyle.

ERC employees’ mental health and wellbeing is paramount for the organization. ERC has provided employees and continues to make accessible to them mental health tips, strategies and resources.

In the Fall of 2020-21, the ERC has secured additional permanent funding to address and support its program capacity and integrity. With this additional ongoing funding, the ERC initiated staffing processes to fill positions that are critical in providing timely case file reviews and will contribute to the integrity of the RCMP’s recourse system.

Despite the pandemic and the adjustment to the new working remotely realities, the ERC completed reviews and issued findings and recommendations for 75 case files. Twenty-seven of these were issued under the current RCMP Act and 48 case files were reviewed under the legacy legislation.

The ERC's reviews, findings and recommendations support the integrity of decision-making in the individual appeal cases reviewed, accountability and the integrity of the RCMP recourse system, and a healthy RCMP workplace.

The RCMP Act requires that the Chairperson establish and make public service standards with time limits for the completion of its case reviews. During this reporting period, two service standards were introduced that will be phased in over fiscal years 2020-2022 with reporting starting in 2022-23.

The reduction of the backlog remains a priority for which the ERC developed strategies to ensure it can provide findings and recommendations in a timely manner.

The searchable database on the ERC's website continues to provide access to regularly-updated summaries of ERC findings and recommendations and of RCMP Commissioner final decisions issued. Four issues of the ERC Communiqué publication – providing the most recent summaries – are also available on the ERC's website.

Internal Services

Description

Internal Services are those groups of related activities and resources that the federal government considers to be services in support of programs and/or required to meet corporate obligations of an organization. Internal Services refers to the activities and resources of the 10 distinct service categories that support Program delivery in the organization, regardless of the Internal Services delivery model in a department. The 10 service categories are:

The Treasury Board of Canada Secretariat granted the ERC an exemption from reporting on Internal Services as a separate program beginning in 2009-10 (given the focused nature of the ERC program and associated resources). This Report, therefore, presents information based on a single ERC program and does not provide information on Internal Services separately.

In the Fall of fiscal year 2020-21, the ERC has secured additional permanent ongoing funding to support program capacity and integrity. With increased resources to deliver on its mandate in a timely and effective manner, the ERC will contribute to the integrity of the RCMP’s recourse system.

With the additional permanent funding the ERC revised its complement of FTE for 2021-22 and ongoing to 33 to deliver its appeal case review program.

The ERC’s total expenses in 2020-21 increased by $411,208 compared to 2019-20 actual results. The increase in expenses in 2020-21 is primarily due to operating expenses in salary.

The ERC’s total liabilities decreased by $54,901 in 2020-21 compared to 2019-20. This is mainly due to a decrease in accounts payable and accrued liabilities.
