C-104 - Conduct Authority Decision

The Appellant appealed the decision of the Conduct Authority (Respondent) who found that he contravened sections 4.6 and 8.1 of the Code of Conduct by engaging in an unauthorized pursuit of a stolen motor vehicle and providing misleading information to his supervisors related to the pursuit.

The Appellant is not appealing the Conduct Authority’s finding on the allegations nor the conduct measures imposed. The Appellant is appealing four decisions of the Director General of the Workplace Responsibility Branch (DGWRB) granting four extensions of the time limitation to impose conduct measures. The Appellant submits that the four decisions are clearly unreasonable.

ERC Findings

The ERC found that the Appellant did not establish that the four extensions were clearly unreasonable. The ERC found that the DGWRB did not unreasonably conclude that the Respondent had a continued intention to pursue the appeal, that there was a reasonable explanation for the delay, and that the extension requests would not cause any significant prejudice to the Appellant. The ERC also found that the Appellant did not establish that the DGWRB erred in his consideration of the factor pertaining to public interest.

ERC Recommendation

The ERC recommends that the appeal be dismissed.
