NC-208 – Stoppage of Pay and Allowances

The Appellant appealed the decision by the Force ordering the Stoppage of his Pay and Allowances (SPA). The SPA order was imposed as a result of Code of Conduct allegations and statutory charges brought against the Appellant in relation to inappropriate sexual relationships he had with two members of the public.

The Appellant argued that the following findings made in support of the SPA order were clearly unreasonable: being on approved sick leave is not a bar to a SPA order, the detrimental impact of the SPA order on the Appellant was not determinative, exceptional circumstances existed to order a SPA, the Appellant was clearly involved in the alleged misconduct, and the requirements to order a SPA were met.

ERC Findings

The ERC found that the Appellant did not establish that these findings were clearly unreasonable.

ERC Recommendation

The ERC recommends that the appeal be dismissed.
