Application: This Canadian Armed Forces Military Personnel Instruction (CAFMPI) applies to officers and non-commissioned members (NCMs) of the Canadian Armed Forces (CAF).

2. Definitions
Individual (personne)
Within the scope of this instruction, this term refers to a CAF member or a person seeking enrolment or re-enrolment in the CAF (a “CAF applicant” at a Canadian Forces Recruiting Centre (CFRC) or Reserve Unit).
Learning Disability (LD) (trouble d'apprentissage)
Any disability that may affect the acquisition, organization, retention, understanding or use of verbal or nonverbal information by an individual who otherwise demonstrates at least average abilities essential for thinking and reasoning. (Defence Terminology Bank record number 694998).
Note – A LD is not specifically a medical issue unless medication is prescribed or the LD is the result of an illness or injury.
Medical Staff (personnel médical)
Within the scope of this instruction, this term refers to Health Care Providers working at a CF Health Services Centre.
Recruiting Staff (personnel de recrutement)
Within the scope of this instruction, this term refers to a Military Career Counsellor (MCC) at a CFRC or Recruiting Staff at a Reserve Unit.
Undue hardship (contrainte excessive)
The limit to which employers and service providers are expected to accommodate in a given situation, taking into consideration, but not limited to, the following factors: availability of options for accommodation; realistic ability to meet the costs associated with accommodation; and health and safety of the public, DND employees and CAF members. Universality of Service (U of S) (universalité du service)
The requirement of CAF members to remain able to perform general military duties and common defence and security duties.
Note – This principle includes, but is not limited to, the requirement to be physically fit, employable and deployable for general operational duties. It is also referred to as the “soldier first” principle. (Defence Terminology Bank record number 47871).
3. Policy Direction
Context
3.1 In accordance with DAOD 5516-5, Learning Disability Accommodation during Recruiting, Training and Education, the duty to accommodate the needs of individuals with LDs is a legal obligation under the Canadian Charter of Rights and Freedoms, Canadian Human Rights Act, and the Employment Equity Act. Therefore, the CAF must accommodate the needs of individuals with LDs during recruiting, training and education unless accommodating those needs would impose undue hardship on the CAF or breach the minimum operational standards related to the principle of U of S set out in DAOD 5023-1, Minimum Operational Standards Related to Universality of Service. Training includes all training activities prior to and post the Operationally Functional Point (OFP), including CAF members’ second language and foreign language training, and education includes CAF members’ education at RMC, RMC Saint-Jean and civilian institutions.
Policy Statement
3.2 The intent of this instruction is to provide direction on how to process a request for LD accommodation during recruiting, training and education.
Note – This instruction does not apply in those cases when the Commanding Officer (CO) is concerned there may be an underlying medical condition (e.g. illness, mental health concern, addiction). In that case, the CAF member should be referred to health services for assessment.
Policy Procedures
3.3 This instruction establishes the procedure that will ensure consistent and fair decisions in the accommodation of individuals with LDs, while ensuring that the operational requirements of the CAF are met.
Application
3.4 This instruction applies to individuals who consent to disclose a LD to the Recruiting Staff or CO during recruiting, training and education by completing Part 1 of Form DND 4458-E, Request for Accommodation for Learning Disability.

Note 1 – If the individual does not complete and sign Part 1 of Form DND 4458-E, no further action is required by the Recruiting Staff or CO. Note 2 – The individual can cease the process laid out in this Table AT ANY TIME. Note 3 – If there is a previous valid Psycho-Educational Assessment report in the CAF member’s Health Services Records, the CAF member may request a copy from their supporting Health Services Records Section. |

Note – If the individual does not complete and sign Annex A or B of the CAFMPI 02/19, no further action is required by the Recruiting Staff or CO and this process ceases.

Note 1 – The Recruiting Staff must includes a copy of the CAF applicant’s original Psycho-Educational Assessment Report with the Enrollment Medical Forms (CF 2027); including any relevant documents used to prepare the report, and the original documents provided by the CAF to assist with the assessment. Note 2 – The CO must ensure a copy of the CAF member’s original Psycho-Educational Assessment Report is sent to the CF Health Services Centre for insertion in the CAF member’s medical file; including any relevant documents used to prepare the report, and the original documents provided by the CAF to assist with the assessment.
Note – ONLY DPGR 4-4 and the Medical Staff are authorized to keep copies of Psycho-Educational Assessment reports. Recruiting centers and Units are NOT AUTHORIZED to keep copies of these reports.
Note – The CO must inform the Unit Claim Section in the event that the CAF member decides not to pursue a Psycho-Educational assessment after the assessment has commenced. |

Note – If the Psycho-Educational Assessment report contain medical information, this information must be severed by DPGR 4-4 and cannot be used for the LD Accommodation Assessment.
Note 1 – If an individual with a LD is not capable of meeting the minimum operational standards related to U of S, the needs of that individual will not be accommodated. Note 2 – Training cannot introduce any accommodation that cannot be maintained in the operational setting. Note 3 – Any accommodation provided must not alter the nature or the level of difficulty of a qualification being assessed.
Note – Any denial of a LD accommodation request must be substantiated based on specific provisions of DAOD 5023-1, officer general specification or NCM general specification, job-based specifications or associated doctrine manuals.
