Consultation on the Revisions to the Agreement for Data Protection under Section 66 of the Pest Control Products Act: Updated Consultation

Health Canada’s Pest Management Regulatory Agency (PMRA) invites stakeholders to comment on proposed revisions to the Agreement for Data Protection under section 66 of the Pest Control Products Act (currently called the Ministerial Agreement for Data Protection under the Pest Control Products Act) following comments received on the 30 December 2016 consultation proposal included with the Review of the Data Protection Program for Pesticides in Canada.

In accordance with section 66 of the Pest Control Products Act, the Agreement is required when an Applicant wishes to follow the formal process specified in the Pest Control Products Regulations to rely on a Registrant’s compensable data to register a generic product. The Agreement is to be used in conjunction with the Pest Control Products Act and Regulations.

The PMRA received several comments during the previous consultation (30 December 2016 to 31 March 2017) on Revisions to the Agreement for Data Protection under section 66 of the Pest Control Products Act (Update to 2010-06-23 Version). The PMRA has reviewed these comments and proposed further changes to the proposed revised Agreement that aim to address many of these comments.

The PMRA will accept written comments on the proposed revisions to the Agreement for Data Protection under section 66 of the Pest Control Products Act up to 30 days from the publication of this document.
