Summary
The Consumer Product Safety Program (CPSP) administers and enforces the Food and Drugs Act (FDA) and its Cosmetic Regulations.
The purpose of this Compliance Verification (CV) project was to verify industry's compliance of cosmetics sold in pressurized containers with the requirements of the FDA and sections 25-27 of the Cosmetic Regulations.
For this project, compliance of select cosmetics in pressurized containers with the FDA and those sections of the Cosmetic Regulations was determined through a sampling and testing process by which Health Canada selected relevant products from both physical and online establishments. Compliance with the applicable requirements under the Regulations was then verified through testing at the Product Safety Laboratory.
Over the course of the 2023 to 2024 fiscal year, flammability testing was carried out on 50 different products, where 45 of the 50 samples were imported. The testing and label review resulted in 4 recalls, 7 stop distributions and 29 commitments to address non-compliances, including one where the product was discontinued. There were 10 instances in which no corrective action was required.
