Pilot project for the issuance of temporary resident counterfoils for clients residing in Canada and holding valid study or work permits

Summary

This Operational Bulletin will provide information about a new pilot project at the Case Processing Centre – Ottawa (CPC-O). Effective immediately, the processing of new temporary resident visa applications for those holding a valid study or work permit will commence at CPC-O.

Background

Currently, study and work permit holders from visa required countries who reside in Canada can apply to extend their study or work permit in Canada but cannot apply for a new temporary resident visa counterfoil to be placed in their passport. The temporary resident visa allows the foreign national to leave and re-enter Canada during their period of study or work. Holding a valid work or study permit does not overcome the requirement to hold a temporary resident visa, but applicants who seek to re-enter Canada from a contiguous territory may be exempt from the temporary resident visa requirement as per R190(3)(f). For those who wish to leave the contiguous territory a new counterfoil is required for re-entry. Often such persons chose to obtain this counterfoil by mail at a visa office in the United States (U.S.).

To support the re-alignment of our North American processing network, this pilot project will allow those already holding a valid work or study permit to apply for a new temporary resident visa counterfoil at CPC-O. CPC-O is an extension of Citizenship and Immigration Canada’s (CIC) overseas visa network.

This pilot project does not preclude clients from continuing to apply for a new temporary resident visa counterfoil at the visa office serving their country of nationality or the country in which they are present and have been legally admitted.

Instructions

As of May 29, 2012, clients from visa required countries present in Canada and holding a valid study or work permit must apply for a temporary resident visa counterfoil at CPC-O or at the visa office serving their country of nationality.

Procedures

Applicants should submit an Application for Temporary Resident Visa to CPC-O. Instructions on how to apply can be found at the following website.

Applicants should be encouraged to apply for a multiple entry visa.

The completed application will be processed as per the usual procedures applied to visitor visa applications at other visa offices abroad, including the requirement of an interview as necessary.

Where further examination is required

If further examination or an interview is required, the application will normally be forwarded to a visa office within the U.S. (New York, Los Angeles, Detroit, Seattle or Washington, D.C.).
