Canada Labour Code Prosecution: Logistec Arrimage (Ontario) Inc. / Logistec Stevedoring (Ontario) Inc.
The incident
On January 24, 2023, an employee of Les Terminaux Rideau Bulk Terminals Inc., an affiliate of Logistec Arrimage (Ontario) Inc. / Logistec Stevedoring (Ontario) Inc. (herein referred to as "Logistec") fatally struck a Logistec employee (herein referred to as the "Logistec employee") with a Pettibone Carry-Lift 254 while transporting and unloading steel pipes at the Port of Johnstown.
Prosecution
Following an investigation by the Labour Program, Logistec was charged with offences under Part II of the Canada Labour Code (the Code).
On October 9, 2025, Logistec pled guilty under subsection 148(1) of Part II of the Code to the following offences:
- failure to ensure that the activities of the employee of Les Terminaux Rideau Bulk Terminals Inc. did not endanger the health and safety of employees, particularly in relation to the operation of a Pettibone Carry-Lift 254, contrary to paragraph 125(1)(y) of the Canada Labour Code
- failure to identify and assess hazards associated with the operation of the Pettibone Carry-Lift 254, the railcar loading activities conducted at the Port of Johnstown, and the specific duties assigned to the Logistec employee, as prescribed in section 19.4 of the Canada Occupational Health and Safety Regulations, contrary to paragraph 125(1)(z.04) of the Canada Labour Code
- failure to ensure, as prescribed by subsection 14.38(2) of the Canada Occupational Health and Safety Regulations, that employees had safe means of entry to, exit from, and occupancy of the workplace, contrary to paragraph 125(1)(p) of the Canada Labour Code
Logistec was ordered by the Ontario Court of Justice to pay a fine of $300,000.
