4 Compliance

4.1 Operator Declaration

The operator of a pulp and paper mill should inform the federal Minister of the Environment in writing that the mill intends to apply the Code of Practice; this notice should be provided no later than {date} (six months after the Code is published).

4.2 Characterization of Air Emissions

The operator of a pulp and paper mill should characterize its atmospheric SO2 and TPM emissions in accordance with the protocol stipulated in Appendix 2.

Initial compliance assessment no later than {date} ( three years after final publication of the Code)

  • Submit the compliance assessment report (deadline: June 1st).

Compliant: If the compliance assessment is positive (compliant);

  • the compliance assessment is complete at frequency established by applicable provincial or municipal authorities, but at least once every four years.
  • submit the compliance assessment report (deadline: June 1st).

Not compliant: If the compliance assessment is negative (not compliant);

  • apply the recommendations from the Code of Practice or any other solution that would result in compliance.
  • the compliance assessment is complete annually.
  • submit the compliance assessment report (deadline: June 1st).

4.3.1 Initial compliance

The operator of a pulp and paper mill should assess its initial compliance with the annual limits specified in Appendix 1 no later than three (3) years following the publication of this Code of Practice.

4.3.2 Follow-up compliance

If the mill complies with the annual limits specified in Appendix 1, the operator of a pulp and paper mill should then assess its compliance with the frequency stipulated by the applicable federal, provincial and municipal authorities, or at least once every four years.

If the mill does not comply with the annual limits stated in Appendix 1, the pulp and paper mill operator should assess its compliance once a year until compliance is achieved. The operator should also apply one or more of the recommended practices, or any other solution that would allow the mill to achieve compliance.

4.4 Compliance Assessment Report

Following each compliance assessment, the operator of a pulp and paper mill that commits to applying this Code of Practice should provide the federal Minister of the Environment with a report containing the following:

A report template for assessing compliance with the Code of Practice is presented in Appendix 4.

The operator should provide the compliance assessment report to the federal Minister of the Environment no later than June 1st of the following calendar year which the measures were carried out.

4.5 Record Keeping

The operator of a pulp and paper mill should retain all relevant files for a minimum of five years after their creation, or longer if prescribed by the applicable federal, provincial or municipal authorities, and should be able to provide them to the federal Minister of the Department of the Environment upon request.
