Background

Phenol, methylstyrenated (MSP) was first assessed in 2008 as a part of the Final Screening Assessment for Potentially Toxic Substances [145 Persistent Bioaccumulative and inherently Toxic (PBiT) substances] and was found not to meet any criteria set out in section 64 of the Canadian Environmental Protection Act, 1999 (CEPA). However, due to concerns regarding its hazardous properties and its potential for bioaccumulation and persistence in the environment, the Significant New Activity provisions of CEPA were applied. Since 2015, multiple Significant New Activity Notifications have been received, resulting in the establishment of ministerial conditions (Nos. 19668 and 19768) and the decision to conduct a further assessment for this substance.

In November 2021, the Government published a draft screening assessment and a risk management scope for MSP. The draft screening assessment proposed to conclude that that MSP was harmful to the environment but not to human health. The related notice was published in the Canada Gazette, Part I. Since then, the Strengthening Environmental Protection for a Healthier Canada Act came into force, and the draft assessment and risk management scope were updated to account for some of the amendments to CEPA. In the updated draft assessment, the Government is proposing that MSP is harmful to the environment but not to human health.
