Who can apply
The eligibility criteria for each family member you include on your application depends on that person’s current location.

Who counts as an eligible family member
The following family members are eligible to apply for permanent residence under this pathway.
A victim’s:: Option 1 of 2
- spouse or common-law partner
- child
- grandchild
- parent
- grandparent
- sibling (including half-siblings)
One of the following relatives of the spouse or common-law partner of a victim:: Option 2 of 2
- child
- grandchild
- parent
- grandparent
- sibling (including half-siblings)
If you’re inside Canada
To apply to immigrate under this pathway, you (the principal applicant) must:
- be an eligible family member of a victim (or their spouse or common-law partner) who passed away on Ukraine International Airlines Flight PS752 and who was approved to work or study in Canada at the time of their passing.
- be in Canada when:
- you submit your application
- you’re granted permanent residence
- live outside of the province of Quebec
- not be inadmissible to Canada except for non-compliance due to the following reasons:
- for having entered Canada without the required visa or other document required under the Immigration and Refugee Protection Regulations
- for having overstayed a visa, visitor record, work permit, student permit or temporary resident permit
- for having worked or studied without being authorized to do so under the Immigration and Refugee Protection Act
Your family members applying from inside Canada must also not be inadmissible except for the reasons above reasons.
You must also meet at least 1 of the following requirements:
- You were in Canada with valid temporary resident status on January 8, 2020.
- You were granted temporary resident status, or were issued a temporary resident permit, after January 8, 2020, and you applied before March 23, 2021.
- You made a refugee claim in Canada between January 8, 2020 and October 27, 2024 (inclusive), were in Canada on October 28, 2024, and have not yet been granted protected person status.
If you’re outside Canada
To apply to immigrate under this pathway, you (the principal applicant) must:
- be an eligible family member of a victim (or their spouse or common-law partner) who passed away on Ukraine International Airlines Flight PS752 and who was either:
- approved to work or study in Canada at the time of their passing
- a Canadian citizen, permanent resident, or individual who had a positive eligibility decision on their application for permanent residence at the time of their passing.
- be outside Canada when:
- you submit your application
- you’re granted permanent residence
- intend to live outside of the province of Quebec
- not be inadmissible to Canada
If you have a refugee claim in progress
If a decision on your refugee claim is pending
If you or any family member included in your application has a pending refugee claim or appeal, and you are successful under one of these public policies, the outstanding claim or appeal must be withdrawn prior to the final approval of your application.
If it is not withdrawn, your application for permanent residence under this pathway will be refused.
If a decision on your refugee claim has been made
You, and your family members in Canada, are not eligible to apply for permanent residence under this pathway if the refugee claim was determined to be:
- ineligible to be referred to the Immigration and Refugee Board
- withdrawn (unless withdrawn immediately prior to being granted permanent residence under this pathway)
- abandoned
- manifestly unfounded or to have no credible basis
- excluded under Article 1F of the Refugee Convention
- ceased
- vacated
