This memorandum explains how the goods and services tax/harmonized sales tax (GST/HST) applies to automobile benefits available to employees and shareholders under the Income Tax Act (the ITA). The rules explaining how the GST/HST applies to taxable benefits (other than automobile benefits) are discussed in GST/HST Memorandum 9.1, Taxable Benefits (Other than Automobile Benefits).

Meanings of significant terms used in this memorandum

Automobile
ss 248(1) of the ITA

1. For income tax purposes, "automobile" means a motor vehicle that is designed or adapted primarily to carry individuals on highways and streets and that has a seating capacity for not more than the driver and eight passengers, but does not include

Employee and employer
ss 123(1)

2. "Employee" includes an officer. "Employer", in relation to an officer, means the person from whom the officer receives remuneration.

Motor vehicle
ss 248(1) of the ITA

3. For income tax purposes, "motor vehicle" means an automotive vehicle designed or adapted to be used on highways and streets but does not include a trolley bus or a vehicle designed or adapted to be operated exclusively on rails.

Passenger vehicle
ss 123(1) of the Act and ss 248(1) of the ITA

4. For GST/HST purposes, "passenger vehicle" has the same meaning as in the ITA. For income tax purposes, a passenger vehicle means an automobile acquired after June 17, 1987 (other than an automobile acquired after that date pursuant to an obligation in writing entered into before June 18, 1987) and an automobile leased under a lease entered into, extended or renewed, after June 17, 1987.

Related persons
ss 126(2)

5. For GST/HST purposes, persons are related to each other if, by reason of subsections 251(2) to (6) of the ITA, they are related to each other for purposes of that Act.

Related individuals
Paras 251(2)(a) and 251(6)(a) and (b), and

6. Pursuant to paragraph 251(2)(a) of the ITA, individuals connected by blood relationship, marriage, common-law partnership, or adoption are related persons. Paragraph 251(6)(a) of the ITA refers to a blood relationship as being that of a parent and a child (or other descendant such as a grandchild or a great-grandchild) or that of a brother and a sister. Section 252 of the ITA extends the meaning of these terms to encompass other individuals who might otherwise not be considered to fit the normal use of the term. Pursuant to paragraph 251(6)(b) of the ITA, two persons are connected by marriage if one person is married to the other person or to an individual who is connected by blood relationship to that other person.

7. An individual is connected by marriage to the parents and any siblings of the individual's spouse. However, where an individual's marriage is dissolved by either divorce or the death of the individual's spouse, the individual ceases to be connected by marriage or to be connected by blood relationship to the parents and any siblings of the individual's former spouse. Paragraph 251(6)(b.1) of the ITA provides that two individuals are connected by common-law partnership if one individual is in a common-law partnership with the other or with a person who is connected by blood relationship to that other person. Shareholder
ss 248(1) of the ITA

8. For income tax purposes, "shareholder" includes a member or other person entitled to receive payment of a dividend.

Treatment of employee and shareholder benefits

9. The treatment of employee and shareholder benefits under the GST/HST is linked to the provisions relating to taxable benefits under the ITA. An example of a taxable benefit is the use of a passenger vehicle.

Overview – taxable benefits

Liability to include tax deemed collectible in net tax calculation
s 173

11. Generally, section 173 applies when a registrant makes a supply of property or a service to an individual who is an employee or a shareholder, or a person related to the employee or shareholder, which gives rise to a taxable benefit under certain sections of the ITA. Section 173 also applies in the case of automobiles where the supply would have given rise to a taxable benefit if the registrant had not been reimbursed. The effect of section 173 is that, subject to certain exceptions (which are discussed in paragraph 37), the registrant must include the tax deemed collectible on the total value of the taxable benefit and any reimbursements (in the case of automobile benefits) in the registrant's net tax calculation. The rules explaining how the GST/HST applies to taxable benefits (other than automobile benefits) are discussed in GST/HST Memorandum 9.1, Taxable Benefits (Other than Automobile Benefits).

Determine the ITA application first

12. To determine whether section 173 applies to a particular supply of property or service to an individual and which provisions within that section apply, it is necessary to first determine the following for income tax purposes:

Determining the GST/HST collectible

14. Once it has been determined that there is a taxable benefit under the ITA, then the following steps must be taken to determine if the GST/HST is required to be remitted on this taxable benefit:

15. Section 173 applies only to persons who are registrants. It also only applies to taxable supplies of property or services made in Canada (other than zero-rated supplies).

Single and multiple supplies

16. When property and/or services are supplied together in any combination, a determination must first be made as to whether multiple supplies were made and, if there were multiple supplies, whether one supply was incidental to that of another. Once the supply or supplies have been identified, then it can be determined whether the supply (or supplies) was exempt or zero-rated. Overview – Automobile benefits

Automobile benefits

17. With respect to automobile benefits, section 173 applies where the supply would have given rise to a taxable benefit if the registrant had not been reimbursed. The effect is that, subject to certain exceptions (see paragraph 37), the registrant must include the GST/HST deemed collectible and collected on the total value of the taxable benefit and any reimbursements in its net tax calculation.

18. Subsection 173(2) provides for an election in respect of

19. Where a registrant has made an election under section 173, the registrant is not entitled to claim input tax credits (ITCs) with respect to the tax paid or payable on the consideration relating to the purchase or lease of a passenger vehicle and its operating costs. This election relieves the registrant from including in its net tax calculation tax deemed collected under subsection 173(1) that resulted from an individual's personal use of the passenger vehicle. See paragraphs 45 to 53 for more information on this election.

Reimbursements and allowances

20. If a registrant provides a cash reimbursement or an allowance to an individual, the registrant has not made a supply of property or service to this individual. More information on allowances and reimbursements will be available in GST/HST Memorandum 9.3, Allowances, and 9.4, Reimbursements.

Persons related to the employer

21. A registrant who makes a supply of property or a service could be a person other than the employer or corporation. For example, this person could be a person related to the employer. The application of section 173 is not restricted to supplies made by the employers and corporations of the individuals who received the taxable benefit.

Individuals and persons related to individuals

22. The registrant must have supplied the property or the service to an individual or a person related to the individual. This individual could be an employee, an officer or a shareholder.

Treatment of automobile benefits under the ITA

Taxable benefits under paras 6(1)(e), (k) or (l), or ss 15(1) of the ITA

23. With respect to automobile benefits, the provisions in section 173 apply only where an amount in respect of the supply is a taxable benefit to an individual under paragraphs 6(1)(e), (k) or (l), or subsection 15(1) of the ITA.

Reimbursements for the use or operation of an automobile
paras 173(1)(a) and (b)

24. With respect to a supply that relates to the use or operation of an automobile, the rules in section 173 apply when the individual, or a person related to the individual, has paid a reimbursement in respect of the supply that reduces the amount of the taxable benefit that would otherwise have been included in income by virtue of paragraph 6(1)(e) (standby charge benefit) or (k) or (l) (operating cost benefit) or subsection 15(1) (shareholder benefit) of the ITA.

Automobiles supplied by partnerships
para 12(1)(y) of the ITA

25. Individuals who are members of a partnership or employees of a member of a partnership are required to include in their income the equivalent of the automobile standby charge when the partnership makes an automobile available in the year to the individual or a person related to the individual. However, since this inclusion in income is under paragraph 12(1)(y) of the ITA and not under paragraph 6(1)(e) or subsection 15(1) of the ITA, the provisions of section 173 do not apply. See paragraph 29 for an explanation of automobile standby charges.

Included in income

26. Under the ITA, when an individual (i.e., an employee or shareholder), or a person related to the individual, receives a benefit in a taxation year that derives from the personal use and availability of an automobile that has been provided in relation to employment or an office of the individual, the value of that benefit is to be included in computing the individual's income for that taxation year.

Taxable benefits for motor vehicles other than automobiles
para 6(1)(a) of the ITA

27. Motor vehicles such as trucks, buses and motor homes that are not included in the definition of "automobile" for purposes of paragraph 6(1)(e), (k) or (l) of the ITA may be subject to personal use. As a result, a taxable benefit from their use may arise under paragraph 6(1)(a) of the ITA. More information on the application of the GST/HST to taxable benefits to which paragraph 6(1)(a) of the ITA applies is available in GST/HST Memorandum 9.1, Taxable Benefits (Other than Automobile Benefits).

Automobile benefits – two components

28. Automobile benefits for income tax purposes consist of two types:

Standby charge benefit
para 6(1)(e) and ss 6(2) and 15(1) of the ITA

29. A standby charge benefit is generally the cost (capital or lease) for the personal use of an automobile made available by an employer or a corporation, or by a person related to the employer or corporation, to an employee or shareholder, or to a person related to the employee or shareholder.

Operating cost benefit
para 6(1)(k) and ss 6(1.1) and 15(1) of the ITA

30. An operating cost benefit is an expense incurred by an employer or a corporation, or a person related to the employer or shareholder, for the operation of an automobile used by the employee or shareholder, or a person related to the employee or shareholder, if there is, or would be, a standby charge benefit to the individual under paragraph 6(1)(e) of the ITA. Operating costs include gasoline and oil, maintenance charges and repair expenses net of insurance proceeds, and licences and insurance. Operating costs do not include interest, capital cost allowance for an automobile owned by the employer, lease costs for a leased automobile, or parking costs.

31. An operating cost benefit for income tax purposes may also arise where an employer pays the operating costs of an employee's own automobile.

Parking costs
para 6(1)(a) of the ITA

32. Parking costs for a motor vehicle could be included in income under paragraph 6(1)(a) of the ITA. More information will be available in GST/HST Memorandum 9.3, Allowances, if the individual is given an allowance and GST/HST Memorandum 9.4, Reimbursements, if the individual is given a cash reimbursement for parking costs.

Standby charge and operating costs benefits conferred on shareholders

33. Both the standby charge and the operating costs pertaining to automobile benefits conferred on shareholders are required to be included in income under subsection 15(1) of the ITA. For example, where shareholders use corporate property such as an automobile for their personal benefit or enjoyment, the value of the use of the property is a taxable benefit under subsection 15(1) of the ITA.

Shareholders in their capacity as employees

34. Where a shareholder is also an employee and an automobile is made available to the shareholder (or a person related to the shareholder) in the shareholder's capacity as an employee, the benefit is included in income under section 6 of the ITA as income from employment rather than under section 15 of the ITA as a benefit conferred on a shareholder. As a result, any reference for GST/HST purposes to taxable benefits to employees would include taxable benefits to shareholders in their capacity as employees. Similarly, a reference for GST/HST purposes to a person related to an employee would include a person related to a shareholder when a taxable benefit to the shareholder arises in the shareholder's capacity as an employee.

Deemed use in commercial activities

Supply of property otherwise than by way of sale
para 173(1)(c)

36. Where property is supplied otherwise than by way of sale, the use made by the registrant in providing the property to the individual, or a person related to the individual, is deemed, for GST/HST purposes, to be use in the registrant's commercial activities. To the extent that the registrant acquired or imported the property or brought it into a participating province for the purpose of making the supply of the taxable benefit, the registrant is deemed, for GST/HST purposes, to have acquired or imported the property or brought it into a participating province for use in the registrant's commercial activities.

Example

A registrant corporation that is not a financial institution owns a passenger vehicle and assigns it to an employee. The vehicle is used 25% in exempt activities, 45% in the registrant's other business activities, and 30% by the employee for the employee's personal use. The vehicle is used 75% in the registrant's commercial activities.

Exclusions from liability to remit the GST/HST on automobile taxable benefits

37. Registrants must calculate and include in their net tax calculation the GST/HST collectible and collected on the supply of passenger vehicle to an individual, or a person related to the individual, that gives rise to a taxable benefit except in the following situations:

38. If a registrant is not entitled to claim an ITC with respect to the tax paid or payable on the acquisition, importation or bringing into a province of a property or service because of the restrictions in section 170, then the registrant is not required to remit the GST/HST on the taxable benefit. Paragraphs 39 to 41 discuss the impact of section 170 to the acquisition of automobiles.

ITC restrictions – property or services exclusively for the personal use, consumption or enjoyment of an individual
para 170(1)(b)

39. A registrant is not eligible to claim an ITC with respect to the GST/HST paid or payable when a property or service is acquired, imported or brought into a participating province by the registrant exclusively (90% or more) for the personal use, consumption or enjoyment of a particular individual who was, is or agrees to become an officer or employee of the registrant, or of an individual related to the particular individual. This restriction does not apply if the registrant supplies the property or service to the individual for consideration equal to its fair market value that becomes due in the reporting period that the property or service is made available to the individual. The restriction also does not apply when, if no amount were payable for the property or service, no taxable benefit would arise under section 6 of the ITA.

Example 1

A registrant purchases an automobile for $29,000, plus taxes, for the exclusive personal use of an employee. The employee's personal use of the automobile results in a taxable benefit to be included in the employee's income. The registrant is not entitled to claim an ITC for the tax paid on the purchase of the automobile. Consequently, the registrant is relieved from remitting tax on the taxable benefit.

Example 2

A registrant in the business of selling automobiles provides one of its automobiles from its inventory to an employee for the employee's exclusive personal use. The automobile's fair market value is $29,000. The employee's personal use of the automobile results in a taxable benefit to be included in the employee's income. Since the registrant's intention when it acquired the automobile was to sell it and not to provide it to the employee, the registrant is entitled to claim an ITC with respect to the tax paid on the purchase of the automobile. As a result, section 173 applies to deem the registrant has collected tax on the taxable benefit unless another exclusion in paragraph 173(1)(d) applies.

Example 3

A registrant purchased an automobile for $29,000, plus taxes, for the exclusive personal use of an employee. In the reporting period in which the employee received the automobile, the registrant invoiced the employee $29,000 as consideration for the automobile. In this situation, the registrant is entitled to claim an ITC for the tax paid on the acquisition of the automobile.

Restricting ITCs
para 170(1)(c)

40. Except where the property is supplied at its fair market value by the registrant to such an individual and the consideration becomes due in that period, no amount may be claimed by a registrant as an ITC in respect of the GST/HST payable on a supply of property that is made in or before a reporting period of the registrant by way of lease, licence or similar arrangement, primarily (i.e., more than 50%) for the personal consumption, use or enjoyment in that period of

Example

A corporation that is a registrant leases a passenger vehicle for $600, plus taxes, per month with the intent of giving the vehicle to a shareholder who will use it primarily for personal use. The personal use of this vehicle results in a taxable benefit to the shareholder. The registrant is not entitled to claim an ITC with respect to the tax paid on the monthly lease payments.

Reasonableness
ss 170(2)

41. A registrant is not entitled to claim an ITC in respect of the tax paid or payable on a property or service that is acquired, imported or brought into a participating province except to the extent that the consumption or use of property or service of such quality, nature or cost is reasonable in the circumstances, taking into account the nature of the registrant's commercial activities. Furthermore, the GST/HST in respect of which the ITC is claimed must be calculated on consideration for the property or service, or on a value of the property, that is reasonable in the circumstances.

Interaction of s 170 and para 173(1)(c)

42. When a supply of property is made otherwise than by way of sale, the use made by a registrant in providing the property to an individual, or a person related to the individual, is deemed under paragraph 173(1)(c) to be use in the registrant's commercial activities. However, the restrictions in section 170 for claiming an ITC on the tax paid or payable on the supply of the property may still apply.

Example

A corporation that is a registrant leases an automobile that it intends to use 40% in commercial activities and 60% for the personal use of its shareholder. The personal use of the automobile results in a taxable benefit to the shareholder under subsection 15(1) of the ITA. Paragraph 173(1)(c) deems the shareholder's personal use of the automobile to be for use in the commercial activities of the registrant. As a result, the registrant's use of the automobile is deemed to be 100% in commercial activities (40% + 60% = 100%).

Even though the automobile's use in commercial activities is deemed to be 100%, the registrant is not entitled to claim an ITC for the tax paid or payable on the lease payments because the registrant leased the automobile with the intent of providing it primarily for the shareholder's personal use. The shareholder's personal use of the automobile results in a taxable benefit to the shareholder under subsection 15(1) of the ITA. However, pursuant to subparagraph 173(1)(d)(i), the registrant does not have to remit GST/HST on the taxable benefit, since the registrant was not entitled to claim an ITC under section 170 for the tax paid or payable on the supply of the automobile.

Property or service where no tax is payable on the acquisition

43. If a registrant acquires property or a service in circumstances where the GST/HST is not payable, the restrictions in section 170 do not apply. Therefore, unless another exclusion applies, the rules in section 173 apply to any taxable benefit conferred on individuals with respect to a supply of property or service.

Example

A registrant purchases a passenger vehicle from a small supplier who is not a registrant, with the intention of giving its employee exclusive personal use of the vehicle. In this situation, section 170 does not apply to deny an ITC on the purchase of the vehicle because the registrant did not pay the GST/HST when the vehicle was purchased. Consequently, unless another exclusion applies, subsection 173(1) will deem the registrant to have collected the GST/HST where the employee's personal use of the vehicle confers a taxable benefit on the employee.

Election deeming a passenger vehicle to be used exclusively in non-commercial activities

Subpara 173(1)(d)(ii) and ss 173(2)

45. In certain circumstances, a registrant may elect to deem the use of a passenger vehicle to be use exclusively in non-commercial activities. As a result, the personal use of the passenger vehicle by an employee or shareholder, or a person related to the employee or shareholder, is not considered to be use in the registrant's commercial activities. Accordingly, the registrant is not entitled to claim an ITC for the GST/HST paid or payable on the acquisition or lease, or the operation of the passenger vehicle, and the registrant is not required to calculate and include in its net tax calculation the GST/HST deemed to have become collectible and collected on the standby charge benefit and/or operating cost benefit.

Effect of the election on taxable benefits under the ITA

46. The election applies only for purposes of the GST/HST. It does not affect any calculations for income tax purposes.

Non-financial institution
para 173(2)(a)

47. A registrant that is not a financial institution may make this election only if the passenger vehicle is leased and the registrant either acquired it for use other than primarily (more than 50%) in its commercial activities or the registrant uses it other than primarily in its commercial activities in a reporting period.

Effect of the election

48. When a registrant makes the election to have an eligible passenger vehicle deemed to be used exclusively in non-commercial activities, the registrant is

49. For a registrant other than a financial institution, the election is effective at the beginning of a reporting period in which the registrant leases the passenger vehicle for use otherwise than primarily in commercial activities or, where it was not initially acquired for such purpose, a reporting period in which the registrant actually uses the passenger vehicle otherwise than primarily in commercial activities. The election cannot apply retroactively to a reporting period in which neither of these conditions was met.

Financial institutions
para 173(2)(b)

50. A registrant that is a financial institution may make this election in a reporting period in which a passenger vehicle is acquired either through purchase or lease, or in which a passenger vehicle so acquired is used.

Effective date – financial institutions
ss 173(2)

51. For a registrant that is a financial institution, the election is effective at the beginning of the reporting period in which the vehicle is purchased, leased or used.

Form GST30

52. To make this election, registrants must complete Form GST30, Election for Passenger Vehicles or Aircraft to be Deemed to be Used Exclusively in Non-Commercial Activities. Registrants are not required to file this form with the CRA, but are required to retain it with their books and records for audit purposes. More than one passenger vehicle may be identified on this form.

Subparas 173(1)(d)(ii), (v) and (vi)

53. If the election is not in effect at the beginning of the calendar year, then the registrant is deemed to have collected the GST/HST collectible on any taxable benefit arising from the personal use of the passenger vehicle by an individual, and must remit this amount unless another of the exceptions applies which provides that the registrant does not have to calculate and remit the GST/HST.

Requirement to remit the GST/HST on automobile benefits

54. Where a registrant makes an automobile available to an individual, which results in a taxable benefit to this individual under paragraphs 6(1)(e), (k) or (l) or subsection 15(1) of the ITA, the registrant is required to calculate and remit the GST/HST on this benefit, unless one of the exclusions applies. See paragraph 37 for more information.

Property or service made available over more than one year

55. Where property or a service is made available to an individual over two or more taxation years, each of the taxable benefit amounts and reimbursements for these years is treated as part of the consideration for the supply of the property or service and is subject to tax in the year it arises. In determining the GST/HST remittance in respect of a particular year's taxable benefit or reimbursement, it is only necessary to refer to the total consideration for the particular year's use of the property or service.

56. The GST/HST deemed collectible by a registrant for an automobile operating cost benefit that arises by virtue of paragraph 6(1)(k) or (l) or subsection 15(1) of the ITA is equal to a prescribed percentage of the total consideration for the benefit. See Appendix B for the prescribed percentages that apply to each province.

Calculating the tax for standby charge benefit

57. The GST/HST deemed collectible by a registrant for an automobile standby charges benefit that arises by virtue of paragraph 6(1)(e) or subsection 15(1) of the ITA is equal to a tax fraction of the total consideration for the benefit. See Appendix C for the tax fractions that apply to each province.

Example 2 – shareholder taxable benefit where the shareholder resides in Nova Scotia

Assume the same facts as above, but, in this example, the individual who received the taxable benefit was a shareholder who was resident in Nova Scotia at the end of 2010.

The HST calculated on the standby charge benefit is equal to:

13/113 × $5,520 = $ 635.04 [i.e., the applicable fraction × standby charge (see Appendix C)]

The HST calculated on the operating cost benefit is equal to:

59. There is no liability for the individual enjoying the taxable benefit to pay the GST/HST to the registrant providing the benefit.

60. The registrant is required to include the GST/HST deemed collectible and collected in its net tax calculation for the reporting period in which the amount was deemed collectible. For example, for an employee's taxable benefits conferred in the employee's 2011 taxation year, a registrant will include the GST/HST deemed collected in its net tax calculation for the period that includes February 29, 2012. For shareholder's taxable benefits conferred in the registrant's taxation year ending June 30, 2012, the registrant will include the GST/HST deemed collected in its net tax calculation for the period that includes June 30, 2012.

Registrant using streamlined accounting methods

61. A registrant that uses the quick method of accounting, the special quick method of accounting for public service bodies or the net tax calculation for charities is required to remit 100% of any tax that is deemed to have become collectible, and to have been collected under subsection 173(1). A registrant that uses those methods to calculate its net tax generally only remits part of the tax that was collected or collectible.

62. Supplies of taxable benefits are not included in determining whether a person is a small supplier or otherwise required to register for GST/HST purposes. Although subsection 173(1) deems the registrant to have collected tax in respect of the supply of a taxable benefit, it does not deem the value of consideration to become due. Therefore, when applying the small supplier threshold in section 148, no amount in respect of the supply of taxable benefits is included in determining the threshold amount.

The following tables outline where there is a requirement for a registrant to remit the GST/HST deemed to have become collectible and collected on the automobile benefits under the ITA. These tables refer to taxable benefits relating to passenger vehicles as this term is defined in subsection 123(1).

Appendix B – Automobile operating cost benefits

For each taxation year of the individual, the following charts provide the percentage used to calculate the GST/HST deemed collectible by a registrant for an automobile operating cost benefit that arises by virtue of paragraph 6(1)(k) or (l) or subsection 15(1) of the ITA. For the purposes of this chart, "location" means

Exception when the location is in Ontario and the registrant is a large business
When the location is in Ontario, the percentage may also depend on whether the registrant is or is not a large business. As a general rule, a person is considered a large business if the person is a registrant and

  • the person has a threshold amount for the recapture of input tax credits (RITCs) of more than $10 million in their last fiscal year that ended before the recapture period, or
  • the person is one of the following financial institutions, or a person that is related to one of the following financial institutions: a bank; a credit union; a corporation that is licensed or otherwise authorized under the laws of Canada or a province to carry on in Canada the business of offering to the public its services as a trustee; an insurer or any other person whose principal business is providing insurance under insurance policies; a segregated fund of an insurer, an investment plan or the person is the Canada Deposit Insurance Corporation.

Exception for large businesses
A registrant that is a large business on December 31 of the taxation year must use the other tax fractions shown above to calculate the GST/HST deemed collectible for a standby charge benefit when the benefit relates to a qualifying motor vehicle that is subject to ITC recapture for the provincial part of HST. A "qualifying motor vehicle" is a motor vehicle acquired in, or brought into Ontario or British Columbia that is licensed, or required to be licensed, for use on a public highway under the laws of the province relating to the licensing of motor vehicles and that weighs, while carrying its maximum capacity of fuel, lubricant and coolant, less than 3,000 kilograms at the time when the vehicle is first licensed, or first required to be licensed, under those laws.

Example

An employee of a GST/HST registrant that is large business has received a taxable benefit of a stand-by charge under the ITA as a result of using an employer-provided automobile for personal driving in the 2015 calendar year. The automobile is a qualifying motor vehicle that was subject to the ITC recapture for the provincial part of the HST. The employee was ordinarily employed in Ontario. The standby charge benefit under the ITA for the employee's 2015 taxation year is $5,424.

The HST calculated on the stand-by charge, which is deemed collectible and collected by the registrant, is equal to 6/106 × $5,424 = $307.02.
