The application of the GST/HST to a supply of a warranty

This article is intended to provide assistance in determining whether a particular product is a warranty for GST/HST purposes and the application of the GST/HST to the supply of such a warranty. The term warranty is not defined in the Excise Tax Act (ETA). However, paragraph (a) of the definition of insurance policy in subsection 123(1) of the ETA refers to a "warranty in respect of the quality, fitness or performance of tangible property" and excludes those warranties in certain situations. Tangible property includes tangible personal property (TPP) and real property. This article focuses on TPP. Further information on the definition of insurance policy is provided later in this article.

To determine the application of the GST/HST to a person's supply of a warranty in respect of the quality, fitness, or performance of TPP, it is first necessary to determine whether a person is making a single supply or multiple supplies. If, at the time of purchase, a person supplies TPP and the person's own warranty in respect of the quality, fitness or performance of the TPP to a buyer, the person is generally making a single supply of TPP.

However, there may be times when a person is supplying TPP and not supplying their own warranty but is acting on behalf of another person who is supplying a warranty in respect of the quality, fitness or performance of the TPP. Note that who is supplying the warranty may not be clear to the buyer. For example, if Supplier A supplies TPP to a buyer and Supplier B supplies a warranty in respect of the quality, fitness, or performance of the same TPP to the buyer (such as an extended warranty effective after the manufacturer's warranty expires), Supplier B's supply of the warranty is likely a separate supply from Supplier A's supply of the TPP. The issue of whether a person is required to charge the GST/HST on a separate supply of a warranty in respect of the quality, fitness, or performance of TPP generally depends on whether the person is a registrant, an insurer and the warranty is an insurance policy as those terms are defined in the ETA.

Under subsection 123(1), a registrant generally means "a person who is registered or required to be registered" for GST/HST purposes, and an insurer means "a person who is licensed or otherwise authorized under the laws of Canada or a province to carry on in Canada an insurance business or under the laws of another jurisdiction to carry on in that other jurisdiction an insurance business". Subsection 123(1) defines an insurance policy to include, in paragraph (a), "a policy or contract of insurance (other than a warranty in respect of the quality, fitness or performance of tangible property, where the warranty is supplied to a person who acquires the property otherwise than for resale) that is issued by an insurer". Supply of a warranty by an insurer

Where an insurer makes a separate supply of a policy or contract of insurance that is a warranty in respect of the quality, fitness, or performance of TPP to a person that acquires the TPP for resale, the warranty is not excluded from the definition of insurance policy. The insurer's issuance of the insurance policy is a supply of a financial service under paragraph (d) of the definition of financial service in subsection 123(1). An insurer's supply of a financial service is an exempt supply under section 1 of Part VII of Schedule V to the ETA unless it is a zero-rated supply under Part IX of Schedule VI to the ETA. An insurer is not required to charge the GST/HST on the consideration (for example, a premium) for an exempt or zero-rated supply of a financial service.

However, where an insurer makes a separate supply of a policy or contract of insurance that is a warranty in respect of the quality, fitness, or performance of TPP to a person that acquires the property otherwise than for resale (for example, for personal use), the warranty is excluded from the definition of insurance policy. As such, the insurer's issuance of the warranty is not a supply of a financial service under paragraph (d) of the definition of financial service. As the insurer's supply of the warranty is not a supply of a financial service or any other exempt supply, it is a taxable supply. If the insurer is a registrant, the insurer is generally required to charge the GST/HST on the consideration (for example, a fee) for the taxable supply of the warranty.

Supply of a warranty by a person that is not an insurer

Where a person that is not an insurer makes a separate supply of a warranty in respect of the quality, fitness, or performance of TPP to another person, the warranty does not meet the definition of insurance policy, whether or not the other person acquires the property for resale. As the supply of the warranty is not a supply of a financial service or any other exempt supply, it is generally a taxable supply. If the person is a registrant, the person is generally required to charge the GST/HST on the consideration (for example, a fee) for the taxable supply of the warranty.

Other situations

Where a policy or contract issued by an insurer provides a combination of coverages including insurance coverages as well as warranties in respect of TPP acquired by a person otherwise than for resale, it is a question of fact whether the policy or contract is an insurance policy under paragraph (a) of the definition of insurance policy in subsection 123(1). Also, in some cases, certain products or contracts may be called warranties but are not warranties in respect of the quality, fitness, or performance of TPP. The application of the GST/HST to such products or contracts is a question of fact. To determine the application of the GST/HST in either of these situations requires a review of all the relevant documentation. References to Canada Border Services Agency's commercial importation forms in Canada Revenue Agency's publications

As discussed in the article "Prepare for CARM today if your business imports into Canada!" published in the Excise and GST/HST News No. 115 on December 12, 2023, the Canada Border Services Agency (CBSA) implemented the CBSA Assessment and Revenue Management (CARM) system in order to modernize and streamline the process of importing commercial goods. CARM is a multi-year digital initiative that has become the official system of record for the collection of duties and taxes for commercial goods imported into Canada.

As a result of the implementation of CARM in October 2024, a number of forms that were previously used in respect of commercial importations, such as CBSA Form B3-3, Canada Customs Coding Form (Form B3) and CBSA Form B2, Canada Customs – Adjustment Request (Form B2), were replaced with the Commercial Accounting Declaration (CAD). Importers are now required to use the CAD as the accounting, correction, and adjustment document in respect of imported commercial goods, which is defined in the Excise Tax Act to mean goods that are imported for sale or for any commercial, industrial, occupational, institutional, or other like use.

A number of Canada Revenue Agency (CRA) publications continue to refer to Form B3 and Form B2 and, in some cases, provide instructions that refer to fields in those forms that have been renumbered in the CAD. References to the old CBSA forms in the CRA publications should therefore be replaced with references to the CAD.

Removal of the fuel charge

On March 15, 2025, the Government of Canada made regulations that cease the application of the federal fuel charge under Part 1 of the Greenhouse Gas Pollution Pricing Act (the Act). As a result, the fuel charge no longer applies in listed provinces (Alberta, Manitoba, New Brunswick, Newfoundland and Labrador, Nova Scotia, Nunavut, Ontario, Prince Edward Island, Saskatchewan, and Yukon) in respect of activities after March 31, 2025.

Filing and reporting

The fuel charge no longer needs to be reported or paid on all types of fuel and combustible waste in listed provinces in respect of activities after March 31, 2025.

Effective April 1, 2025, fuel charge filing requirements for registered persons and obligations for non-registered persons have ceased. Registered and non-registered persons must still file any required fuel charge returns and pay any amounts owing for reporting periods prior to April 1, 2025.

Persons previously subject to a charge for fuel held in a listed province on adjustment days are not required to file Form B402, Fuel Charge Return on Fuel Held in a Listed Province on Adjustment Day, or the related schedule for April 1, 2025. Persons must still file any outstanding adjustment day returns and pay any amounts owing for adjustment days up to and including April 1, 2024.

Registered persons must file Form B400, Fuel Charge Return – Registrant, and the related schedule for the period ending March 31, 2025.

Registration/cancellation

Persons that were neither registered nor required to be registered on March 31, 2025, are no longer required or permitted to register for the fuel charge after that date.

Effective November 1, 2025, all fuel charge accounts (CT endorsement) will be cancelled without any action required by registrants and affected non-registrants. Persons are still able to claim a rebate or amend returns in reporting periods prior to cancellation in accordance with the existing statutory time limitations.

Audit

Current fuel charge audits in process along with closing audits will be completed over the next few years. Prepayment review of rebate claims will also continue as claims are filed.

Section 111 of the Act limits reassessments of amounts payable to four years from the date the amount became payable. However, an assessment may be made beyond four years where a misrepresentation attributable to neglect, carelessness, or wilful default is made, or where fraud has been committed.

Exemption certificates no longer apply in respect of a delivery of a type of fuel in a listed province on or after April 1, 2025. Section 104 of the Act provides that persons that are required to keep records must retain them for a period of six years after the end of the year to which the documents relate.

Prescribed rates of interest

The prescribed annual rate of interest in effect from July 1, 2025, to September 30, 2025, on overdue amounts payable to the Minister is 7%. The prescribed annual rate of interest on amounts owed by the Minister (such as, rebates or refunds) is 3% for corporate taxpayers and 5% for non-corporate taxpayers. These rates are applicable to income tax, excise taxes, GST/HST, underused housing tax (UHT), air travellers security charge (ATSC), luxury tax, fuel charge (under the Greenhouse Gas Pollution Pricing Act), and excise duties on wine, spirits, tobacco, cannabis, and vaping products.

The prescribed annual rate of interest respecting excise duty on beer products, on overdue amounts payable for the indicated period, is set at 5%. Refund interest rates are not applicable for amounts owed by the Minister (such as, rebates or refunds) for excise duty that is in relation to beer products.

* The Canada Revenue Agency (CRA) will provide interest relief on existing GST/HST and T2 balances between April 2 and June 30, 2025. There is no need to provide proof of hardship from or impact of tariffs. The CRA will automatically grant relief on GST/HST and T2 accounts during the relief period.
