Federal Budget 2025

On November 4, 2025, the Minister of Finance and National Revenue tabled Budget 2025, which proposed amendments to the Excise Tax Act, the Underused Housing Tax Act, the Select Luxury Items Tax Act, and other related legislation. These amendments are included in Bill C-15 which has not yet received Royal Assent.

The following two articles provide more detailed information on some of the proposed amendments included in Budget 2025.

Elimination of the Underused Housing Tax for 2025 and subsequent years

On November 4, 2025, as part of Budget 2025, the Minister of Finance and National Revenue tabled a Notice of Ways and Means Motion to amend the Underused Housing Tax Act, to eliminate the Underused Housing Tax (UHT) for the 2025 calendar year and subsequent years. Under these proposed amendments, no UHT is payable, and no UHT return is required to be filed in respect of the 2025 calendar year or subsequent years.

These proposed amendments do not affect the application of the UHT to the 2022, 2023 or 2024 calendar years. Existing filing and payment obligations for these years, as well as related penalties and interest provisions remain in effect.

End the Luxury Tax on Subject Aircraft and Vessels

Introduced on September 1, 2022, the luxury tax applies to sales, leases, importations, and certain improvements of subject vehicles, aircraft, and vessels priced above relevant thresholds under the Select Luxury Items Tax Act. Specifically, the luxury tax applies to subject vehicles and aircraft priced above $100,000 and subject vessels priced above $250,000.

On November 4, 2025, as part of Budget 2025, the Minister of Finance and National Revenue announced a proposed measure to eliminate the luxury tax on subject aircraft and subject vessels effective November 5, 2025.

Under this proposed measure, the luxury tax would no longer be payable on subject aircraft or subject vessels priced or valued above the relevant thresholds. However, the luxury tax would continue to apply to subject vehicles priced or valued above $100,000, unless an exemption applies. Administrative Considerations

Although the luxury tax on subject aircraft and vessels is proposed to end, registrants should note that the CRA retains the right to inspect, audit, or examine records as part of its enforcement and compliance obligations. All records must be kept for six years after the end of the year to which they relate.

Illegitimate GST/HST Rulings or Interpretation Letters

The Canada Revenue Agency (CRA) has recently become aware of the existence of illegitimate letters that purport to be GST/HST rulings or interpretations issued by the GST/HST Rulings Directorate. Such letters appear similar to official CRA correspondence but often contain irregular formatting or incomplete technical explanations. Some even reference the names of CRA officials or information taken from public sources. These letters appear to be used by taxpayers to legitimize non-compliant GST/HST practices without the CRA's knowledge.

The CRA is exploring measures to protect the integrity of the GST/HST Rulings and Interpretations Service. If you receive a letter that is being presented as an official GST/HST ruling or interpretation, and you have concerns about its authenticity (for example, where the content appears technically inaccurate or unusually specific to a third party) you can contact GST/HST Rulings at 1‑800‑959‑8287. A GST/HST Rulings officer will assist in confirming whether the correspondence has been issued by the CRA.

A GST/HST ruling applies only to the taxpayer who requests it (or on whose behalf it is requested) and only to the issues specifically covered by the ruling. You can request a ruling or interpretation on how the GST/HST applies to a specific transaction for your operations. This service is provided free of charge. Carrying forward amounts and claim periods for a public service body or pension entity rebate filer

In March 2015, the Canada Revenue Agency sent letters to registered and non-registered filers of public service bodies' (PSB) and pension entity rebates. The purpose of the letters was to explain the proper rebate claim period as defined under subsection 259(1) of the Excise Tax Act.

For registrants, the claim period for rebates is the same as their GST/HST return's reporting period (that is, annual, quarterly or monthly). This means that a registrant will have either, one, four or twelve claim periods per year, depending on the filing frequency of its GST/HST return.

For non-registrants, a claim period consists of either the first and second fiscal quarters in a fiscal year, or the third and fourth fiscal quarters in a fiscal year. This means that a non-registrant that claims a rebate will have two rebate claim periods per year (the first six months and the last six months of its fiscal year). A non-registrant is not allowed to have a 12-month claim period.

Authorized division or branch accounts, regardless of their filing status, must use the same fiscal year end and claim period as their head office.

Each rebate application covers one claim period and generally only includes the GST/HST that became payable during the claim period or that was paid during the claim period without having become payable. However, a PSB rebate of the GST/HST paid or payable on an eligible purchase or expense for a particular claim period may be claimed on the rebate application for a later claim period if the criteria listed under the heading "Carrying forward a rebate" in Guide RC4034, GST/HST Public Service Bodies' Rebate are met. This means that claimants may be able to combine multiple claim periods and consolidate them into one rebate application. The carry forward rules apply to later claim periods ending after September 8, 2017.

For example, if a non-registrant's fiscal year-end is December 31, it has two claim periods (one for January to June and another for July to December). If all the conditions are met, it can choose to file one rebate for the second half of the year, from July 1 to December 31, and include amounts from both periods.

Another example is a division that does not file rebate applications regularly but has a head office that files GST/HST returns every month. If all the conditions are met, this division is allowed to submit one rebate application for the December claim period that includes amounts for the whole year. In other words, this division no longer has to file rebate claims every month.

However, carrying-forward is only permitted where the applicable PSB rebate rate did not change at any time from the beginning of the claim period in which the GST/HST was paid or payable to the end of the later period where the PSB rebate would be claimed. Therefore, some PSB rebate claimants resident in Prince Edward Island and New Brunswick may not be able to combine their PSB rebates for certain claim periods. The application of the definition of emission allowance and the Alberta Technology Innovation and Emissions Reduction (TIER) Regulation

An article titled Instruments considered to be an emission allowance published in Excise and GST/HST News – No. 113 attempted to clarify the Canada Revenue Agency's (CRA's) position as to when instruments (for example, credits and offsets) are issued or created by, or on behalf of, a government or an international organization (a "regulator") or by a body established by, or an agency of, a regulator, as required under subparagraph (a)(i) of the definition of emission allowance in subsection 123(1) of the Excise Tax Act (ETA). The CRA's position has evolved since the publication of this article, and the approach used in the application of subparagraph (a)(i) of the definition of emission allowance has changed. The CRA therefore wishes to provide an update on its position, specifically regarding the application of the definition of emission allowance as it relates to performance credits, emission offsets and sequestration credits generated under the Alberta Technology Innovation and Emissions Reduction (TIER) Regulation, Alta Reg 133/2019 (TIER Regulation).

An emission allowance is defined in subsection 123(1) of the ETA as:

To meet the definition of emission allowance, an allowance, credit or similar instrument must satisfy all the criteria set out in paragraph (a), or be prescribed in paragraph (b) of the definition of emission allowance. Currently, no property is prescribed.

The CRA reviews and analyses the applicable federal or provincial legislation relating to these types of instruments on a case-by-case basis.

For an instrument to meet the criterion in subparagraph (a)(i) of the definition, the instrument must be "issued or created by, or on behalf of", a regulator, board, commission or other body of a regulator, or an agency of a regulator. In performing an analysis, the CRA does not simply look for the terms "issued" or "created" in the relevant legislation, but also considers the broader context of that legislation, and how the instrument comes into being, or is put into circulation.

The CRA recently examined whether emission performance credits, emission offsets and sequestration credits generated under the TIER Regulation meet the definition of emission allowance in subsection 123(1) of the ETA. In reviewing the context of the Regulation (along with Alberta's Emissions Management and Climate Resilience Act, SA 2003, c. E-7.8, and the Standards which form part of the TIER Regulation), the CRA has determined that emission performance credits, emission offsets, and sequestration credits generated under the TIER Regulation meet the definition of emission allowance in subsection 123(1) of the ETA.

The position described in Excise and GST/HST News - No. 113 is revoked as of the date of this publication. The CRA will continue to review the relevant Canadian federal and provincial legislation on a case-by-case basis, as requests are received, to determine which existing credits, allowances and other instruments are an emission allowance, as defined under subsection 123(1) of the ETA. As decisions are rendered and where appropriate, the letters relating to these decisions will be severed and published.

The CRA will administer this revised position prospectively based on the specific facts of each case.

Accessing your GST/HST access code in the My Business Account portal

Effective October 20, 2025, business owners are able to view their GST/HST access code online through the secure My Business Account (MyBA) portal.

The GST/HST access code is a personal security key used to authenticate your identity when submitting GST/HST returns outside of the Canada Revenue Agency's secure portals. This code is only required if you choose to file your GST/HST returns using one of the following services:

As a business owner, you can find your access code on the "View expected and filed returns" page within MyBA. To access this page, navigate to the "Returns" tab on the RT Overview page, then select the "View return details" button.

The access code will not be visible to any representatives accessing the account via the Represent a Client online service, regardless of their authorization level.

Prescribed rates of interest

The prescribed annual rate of interest in effect from October 1, 2025 to December 31, 2025 on overdue amounts payable to the Minister is 7%. The prescribed annual rate of interest on amounts owed by the Minister (such as, rebates or refunds) is 3% for corporate taxpayers and 5% for non-corporate taxpayers. These rates are applicable to income tax, excise taxes, GST/HST, underused housing tax (UHT), air travellers security charge (ATSC), luxury tax, fuel charge (under the Greenhouse Gas Pollution Pricing Act) and excise duties on wine, spirits, tobacco, cannabis and vaping products.

The prescribed annual rate of interest respecting excise duty on beer products, on overdue amounts payable for the indicated period, is set at 5%. Refund interest rates are not applicable for amounts owed by the Minister (such as, rebates or refunds) for excise duty that is in relation to beer products.

* The Canada Revenue Agency (CRA) will provide interest relief on existing GST/HST and T2 balances between April 2 and June 30, 2025. There is no need to provide proof of hardship from or impact of tariffs. The CRA will automatically grant relief on GST/HST and T2 accounts during the relief period.
