Wage Earner Protection Program for trustees or receivers: Proof of claim

From: Employment and Social Development Canada

4. Proof of claim

Pursuant to the Wage Earner Protection Program Regulations, you are required to inform individuals of their obligation to file a Proof of claim. You are also required to confirm receipt of the Proof of claim on the trustee/receiver information form.

The confirmation of the Proof of claim by the trustee/receiver is required before a WEPP payment can be issued.

If you receive a Proof of claim after you have already submitted a trustee/receiver Information Form, an amendment to the Proof of claim is required. When Service Canada receives the amended trustee/receiver information form, the individual's eligibility will be reexamined.

The Government of Canada will not file a Proof of claim with trustees/receivers for its subrogated claim, as the Proof of claim filed by the applicant is sufficient.

Note: Trustees/Receivers are not required to send a copy of the Proof of claim to Service Canada.
