Section 71 Chemicals Management Plan 2023
In June 2023, a notice was published in the Canada Gazette, Part I: Vol. 157, No. 25 – June 24, 2023 under section 71 of the Canadian Environmental Protection Act, 1999 (CEPA 1999). This notice applies to 3 substances in this batch (CAS RNs 91-08-7, 75-56-9 and 91-20-3). 2017 Mandatory survey – section 71 notice
In April 2017, a notice was published in the Canada Gazette, Part I: Vol. 151, No. 13 – April 1, 2017 under section 71 of CEPA 1999. This notice applied to 3 substances in this batch (CAS RNs 91-08-7, 584-84-9, 26471-62-5) as well as 47 other substances that are toxic or that were proposed to be toxic as defined under section 64 of CEPA 1999.
2007 Mandatory survey – section 71 notice
In February 2007, a notice was published in the Canada Gazette, Part I: Vol. 141, No. 5 under section 71 of CEPA 1999. This notice applied to 13 of the 15 substances in this batch. The remaining 2 substances (CAS RNs 91-20-3 and 54079-53-7) had been surveyed under a previous section 71 notice, and the Government had obtained sufficient information. They were therefore not included in the February 2007 notice.
Substance Groupings Initiative
The following substances in this batch have been included in the Aromatic Azo and Benzidine-based Substance Grouping under Substance Groupings Initiative as part of the second phase of the CMP. As outlined in the notice of intent for the Aromatic Azo and Benzidine-based Substance Grouping, it was recognized that assessments and conclusions pertaining to some of the substances in the grouping may be subsequently updated as part of the subgroup assessment. The latest updates on these substances are found on the respective Substance Groupings Initiative web pages.

Risk management action milestones
The risk management action milestones table outlines the risk management actions that were proposed for each chemical substance in this batch of the Challenge that met the criteria of section 64 of CEPA 1999. These proposed risk management actions were published in the risk management approaches for these substances. Adding substances to Schedule 1
Nine substances in this batch were proposed to be added to Schedule 1. One substance, CHPD, was proposed to be added to Schedule 1; however new evidence in the form of data on bioaccumulation has led to the re-evaluation of the risks, conclusions and final decision previously published. The former recommendation to add CHPD to Schedule 1 to CEPA 1999 is annulled. Therefore, 5 substances and 1 group of 3 substances in this batch have been included in final orders to add to Schedule 1.

Varying the requirements under the Significant New Activity provisions
In January 2017, a notice of intent to amend the DSL to vary the SNAc requirements for methyloxirane (CAS RN 75-56-9), ethyloxirane (CAS RN 106-88-7), and hydroquinone (CAS RN 123-31-9) was published in the Canada Gazette, Part I: Vol. 151, No. 2 – January 14, 2017. The proposed amendments are an outcome of the SNAc Review. The DSL amendments are not in force until the final order is adopted by the Minister of the Environment and Climate Change pursuant to subsection 87(3) of CEPA 1999. The final order will be published in the Canada Gazette, Part II. Any current SNAc requirements remain in effect until such time as the final order is published.

Final screening assessments and risk management approaches
In September 2011, the revised final screening assessment on CHPD was released and the related notice was published in the Canada Gazette, Part I: Vol. 145, No. 37 – September 10, 2011. This publication is pursuant to a notice of objection, received in November 2008, concerning the proposed order adding CHPD to Schedule 1 of the Canadian Environmental Protection Act, 1999.
In July 2008, the final screening assessments for this batch were released and the related notices were published in the Canada Gazette, Part I: Vol. 142, No. 27 – July 5, 2008. Proposed risk management approaches were also released on these dates for the substances in this batch which met the criteria in section 64 of CEPA 1999.
The final screening assessments (published in July 2008) concluded that 9 substances in this batch meet one or more criteria in section 64 of CEPA 1999. The Government proposed to add these substances to Schedule 1 to the Act. However, new evidence in the form of data on bioaccumulation has led to the re-evaluation of the risks, conclusions and final decision previously published for 1 of these substances, CHPD. The former recommendation to add CHPD to Schedule 1 and to the Virtual Elimination List is annulled.
Draft screening assessments and risk management scopes
New information was received from industry or interested stakeholders for each of the 15 substances in this batch. In January 2008, the draft screening assessments were released and the related notices were published in the Canada Gazette, Part I: Vol. 142, No. 3 – January 19, 2008. Risk management scopes were also released in conjunction with these publications.
New evidence in the form of data on bioaccumulation has led to the re-evaluation of the risks, conclusions and final decision previously published regarding 1 substance (CHPD). The previous draft screening assessment published in July 2008 is annulled. In July 2010, the draft screening assessment was released and the related notice was published in the Canada Gazette: Vol. 144, No. 27 – July 3, 2010 for a 60-day public comment period.
