The objective of the proposed Vaping Products Reporting Regulations is to require manufacturers and importers of vaping products to provide timely and relevant information on their vaping products to Health Canada, which would then be used to inform the development of policies and regulations. Mandatory public disclosure of information by the Minister as well as measures to enhance compliance with the reporting requirements would also be included in the regulatory proposal.

Potential impacts on Canadians, including businesses

This proposal would impact manufacturers and importers of vaping products (vaping devices and substances) who would be required to prepare reports that must be submitted to the Minister of Health. This proposal is not expected to directly impact Canadian consumers.

There are no expected impacts on international trade or investment, since this is not a pre-market approval process.


In response to the House of Commons' Standing Committee on Health, the report entitled Vaping: Towards a Regulatory Framework for E-cigarettes, Bill S-5, an Act to amend the Tobacco Act, the Non-Smokers' Health Act and to make consequential amendments to other Acts was introduced in the Senate on November 22, 2016.

On May 23, 2018, the Tobacco and Vaping Products Act received Royal Assent.

Health Canada consulted Canadians on the proposed Vaping Products Reporting Regulations through the publication of a consultation paper, which was published on in August 2017 for a 60 day public comment period. The public comment period was open until October 27, 2017.

Canadians will have the opportunity to provide input on the regulatory proposal during the Canada Gazette, Part I public comment period, which is expected to take place in winter 2020 and last 75 days.
