Forward Regulatory Plan 2022-2024: Vaping Products Reporting Regulations

Title of Regulatory Initiative

Vaping Products Reporting Regulations

Enabling Act

Tobacco and Vaping Products Act

Description

Health Canada is proposing amendments to the Vaping Products Reporting Regulations to require manufacturers and importers of vaping products to provide timely and relevant information on their vaping products to Health Canada, which would then be used to inform the development of policies and regulations.

Regulatory cooperation efforts (domestic and international)

This initiative is not part of a formal regulatory cooperation work plan.

Potential impacts on Canadians, including businesses

This regulatory proposal would affect manufacturers and importers of vaping products (vaping devices and substances) who would be required to prepare reports that must be submitted to the Minister of Health. This regulatory proposal is not expected to directly affect Canadian consumers.

There are no expected impacts on international trade or investment, since this is not a pre-market approval process.

Consultations

Health Canada consulted Canadians on the proposed Vaping Products Reporting Regulations through the publication of a consultation paper in August 2017.

A summary of the consultation was published in a What We Heard Report: Consultation summary: proposals for the regulation of vaping products.

Canadians will have a further opportunity to provide comments on the regulatory proposal during the Canada Gazette, Part I, public comment period, which is expected to take place in spring 2022 and last 45 days.

Information on previous consultations and details on upcoming opportunities for consultation in the area of tobacco and vaping can be found on the Canada.ca website.
